I have been warning agents that the NAR Settlement was just the beginning of this.  More lawsuits and government intervention would soon follow. Today I discuss a $3.29 million settlement/fine involving real estate agents and title insurance.

I actually applaud this settlement as a positive step forward for the consumer.  If you are doing these schemes you need to stop now or face massive fines and possible class action lawsuits!

Now that we are a week or so into the new rules on real estate compensation, we need to discuss how your commission might be shown on the settlement statements. Direct compensation, concessions and broker to broker commission most likely will be handled differently and you need to know what to look for on the ALTA. I also will discuss what documentation you might need to provide the closing attorney and the lender.

In May 2024 Governor McMaster signed the revised SC Code §40-57-10 into law. In that statute that governs the practice of real estate in South Carolina there are several provisions dealing with "wholesaling".   Today we will examine the statutes to determine if wholesaling is illegal or not in South Carolina as well as why real estate agents should consider adding several investors as clients.

September is real estate agent safety month.  Before you say "nothing is going to happen to me, happens in my small town, or to someone like me", think again. Just this week an agent in Aiken was sexually assaulted.  In 2018 alone, Inman News reported that 9% of real estate agents reported having been attacked or physically threatened performing their job.  Last year I documented six foot-five Jason Compton's story which can be found here. So it can happen to you, in your town, and to someone even bigger or stronger than you.

It is with the heaviest of hearts that the Blair Cato Pickren Casterline, LLC family announces that founding partner Rex L. Casterline went to be with the Lord on Monday August 15, 2022 after a brief and sudden illness. Please keep the Casterline family and the extended Blair Cato family in your prayers.

One of my passions is Major League Baseball.  I have personally been to 22 of the 30 stadiums and I live and die by the Atlanta Braves. So in the Bonus Episode I got to totally geek out with former Major Leaguer turned real estate agent, Tyler Wilson, and ask him a ton of questions about playing baseball for the Baltimore Orioles.  If you are a baseball fan, you will want to check this out.

To be the best at real estate you need to develop mindset, routine, work/life balance, as well as learning to deal with failure, disappointment and self-doubt.  These are the same skill set that professional athletes must develop to reach the highest level of their sport.  Today former Major League Baseball Player turned real estate agent, Tyler Wilson (Baltimore Orioles) discusses how he developed these skill sets and was able to apply them to his real estate business. The real estate industry as a whole is very slow to change.  It took many years for technology and apps to take hold in the market. Today we are staring at a dramatic change in how real estate closings will be performed in South Carolina beginning in 2023 and beyond.  The introduction of In-person Electronic Notary (IPEN) will create tremendous structural changes. If the Congress passes nationwide Remote Online Notary (RON) then the distance closing will also change dramatically.  All of this is for the better. 

My law partner, Cynthia Blair, joins Dishin' Dirt today to discuss what IPEN and RON are and how the introduction of these services will forever change the face of real estate closings.
