State Game Commissions set hunting seasons and bag limits, and direct wildlife management of all species in their states. Anti-hunters know this, which is why Commissions are under attack. The guys discuss a proposal in Colorado that could take authority away from the state game commission and lead to a reduction in hunting opportunities. They also discuss some of the chaos that's going on with the Washington Game Commission. 

Nephi shares stories from a recent waterfowl hunt in Nebraska, and Dave shares the origins of his waders. Then the guys explore a brief history of waterfowl and wetland issues in the United States, the Constitutional limits of the Clean Water Act, and the importance of states and private enterprise in protecting wetlands. 

Massive fires are burning across the western United States.  Politicians are casting blame, and conspiracy theories are flooding the internet. In this episode, the guys take on the topic of forest management. They discuss the history of US management, different factors that are contributing to today's fires, and some (very general) suggestions to tackle the problem in the near and long-term. Also, hear their take on the decision that removed William Perry Pendley from the helm of BLM. 

On September 22, 2020, the Senate Environment and Public Works Committee will hold a hearing on the "Endangered Species Act Amendments of 2020." The bill isn't going anywhere in this Congress, but as the guys discuss, some of the ideas it contains might warrant discussion. The proposal to sell or otherwise dispose of hundreds of thousands of acres of public land in Nevada and Utah was pulled from the US House Reconciliation bill. The guys talk about how it happened, and how Representative Zinke's red line, along with hundreds of thousands of public lands lovers from across the country speaking out, helped pull a rabbit out of a hat. They also discuss what still lies ahead with the Senate. Many conservation organizations rely heavily on the revenue generated from banquets to fund their work. The COVID-19 pandemic is forcing many of these groups to cancel these critical fundraising events. They guys discuss: (1) the importance of donating to your favorite organization right now; (2) parts of the recent Congressional stimulus package meant to help these groups and; (3) how to recreate safely during the pandemic. It happened. Through a middle of  the night amendment to the House Natural Resources Committee Reconciliation bill, nearly 500,000 acres of public lands in Utah and Nevada were identified for expidited sale/exchange. The guys break this down, and give some options for staying engaged in the process.

Government feeding programs for elk are controversial. However, the guys don't shy away from controversy. State legislatures are in session all over the country, which means anything is possible, and hunters need to be engaged in the process to protect their interests. The guys highlight a handful of good and bad bills from around the country, and explain why what happens in one state can impact another. Laying the groundwork for a discussion on the rules for defining the phrase Waters of the United States, Nephi and Mike run through the process of Congress writing laws, agencies creating implementing regulations backed up by guidance, and how those regulations can be challenged in court. It is a clean overview of the process that is carried out all the time at the federal and state levels of government. 

The guys bring you two episodes in one to discuss the policy and science of using traditional lead ammunition and alternatives. Episode 1 features ballistics and ammunition expert Ryan Bronson discussing the use of traditional lead ammunition. Episode 2 features Chris Parish and Leland Brown of the North American Non-Lead Partnership discussing non-lead alternatives. Spoiler: everyone agrees there is no need to further regulate lead ammunition, but there's still a lot to unpack here. Enjoy the dialogue!

You've probably seen the rumors about selling public lands using a process called Reconciliation. But, what exactly is that process, and what would it mean for public lands. The guys break down the Reconciliation process, and why public lands are on the radar of some law makers. Then, they talk about the Federal Land Transaction Facilitation Act, and explain why selling lands that may even already be deemed suitable for disposal through Reconciliation vs. the established process through FLPMA would only serve to hurt public lands. Lastly, they'll talk about what you can do to get involved. Oh, yeah, they also have a bro-country battle that nearly gets Nephi expelled from the podcast.

The Pittman-Robertson Act of 1937 provides critical funding to state wildlife agencies (paid by hunters and recreational shooters) to manage wildlife. Last week, two bills passed the House Natural Resources Committee that would amend the Pittman-Robertson Act to help recruit new hunters and provide more resources to state wildlife agencies to manage wildlife and habitat. The guys tell you all about the bills, and the steps remaining before they become law. 

Hunters are on the decline nationwide, which means so is funding for wildlife management. The guys talk about how to fund the future of wildlife management. Topics covered include: state and federal funding efforts; why non-consumptive user really means non-contributory user; why hunters need non-hunters; the need for non-hunters to contribute to wildlife management; and more. The 10th Circuit Court of Appeals just found that corner crossing--the act of crossing from one parcel of federal land to another parcel of federal land while momentarily passing through the airspace of a private landowner--is legal (in 6 states). Dave and Nephi explain the decision, talk about the states where the judgment applies, and what it means for hunters, anglers, and recreationists everywhere.  If you've listened to prior episodes, you know we've been urging restraint and seeking more clarity from the court.
