Episode 40: Federal Court deemed the Emergencies Act violated charter. Now what?24 Jan 202400:24:15

The Federal Court has ruled the use of the Emergencies Act by the Trudeau government as a violation of charter.

In his ruling, Justice Richard G. Mosley wrote “I have concluded that the decision to issue the Proclamation does not bear the hallmarks of reasonableness — justification, transparency and intelligibility — and was not justified in relation to the relevant factual and legal constraints that were required to be taken into consideration.”

Deputy Prime Minister Chrystia Freeland says that Ottawa will appeal the ruling.

Many supporters of the truckers convoy that occupied Ottawa for a month and a day are celebrating this as a win.

Despite their political differences, another former Prime Minister, Stephen Harper, sent him a birthday greeting, suggesting that former opponents can bury the hatchet over time. 

This display of camaraderie and respect between former leaders is a rarity in today's political climate. 

In contrast, current political leaders, Prime Minister Justin Trudeau and Conservative Leader Pierre Poilievre, do not seem to have this same level of respect for one another.

“Released by Ontario's Ministry of Municipal Affairs and Housing as a result of a series of freedom of information requests show that it was partisan Minister’s Office staff — not civil service experts — who directed changes to municipal  Official Plans in ways that favoured select landowners and sprawl developers. 

“The documents also show that their lands were designated for development despite being rejected by both municipal planners and provincial Municipal Affairs planning experts. The documents also offer evidence that Ministers' offices, other than that of Housing Minister Steve Clark, were involved as early as January 2022, prior to the June 2022 election, and yet the government still kept Ontario voters in the dark.”
