We are back with another Legal Brief to discuss the sentencing of Caleb Flynn with Alleigha Botner's lawyer, Nick Gounaris.  Earlier this week, Caleb Flynn was convicted in Troy, Ohio of murdering his wife, Ashley Flynn. No sentencing memorandum has been filed by Caleb Flynn's defense team, which has left Nick and Tony both scratching their heads as to what is likely to happen next week. Flynn's sentencing hearing is scheduled for Monday, October 5th in Miami County.

Alleigha Botner's Attorney Speaks Out on the Caleb Flynn Trial- #2401 oct. 202601:30:54

Caleb Flynn was charged with murdering his wife, Ashley Flynn, earlier this year in Troy, Ohio. This week, a jury convicted him on all 9 felony counts that he faced. During their closing, Flynn's defense team took the time to say some pretty horrible things about our client, Alleigha Botner. However, since Nick is her lawyer (and also just so happens to be the co-host of Legal Chaos) we are taking the time to set the record straight.

This week we were joined in the studio by Sergeant Kyle Thomas of the Dayton Police Department. Kyle is a 17-year veteran of the Dayton Police, president of the Dayton Fraternal Order of Police (Lodge 44), and also serves on the Board of Trustees of the Ohio Police & Fire pension fund. We had a chance to discuss flock cameras, traffic stops, public perception of police, the "blue wall", use of force, and much more. 

WHO SHOT TUPAC?! The Trial of Keefe D- #2227 août 202601:05:29

This week on Legal Chaos, Nick and Tony take a deep dive into the Keefe D trial for aiding and facilitating the shooting of Tupac Shakur. The shooting of Tupac Shakur was a decades-old cold case until 2019, when, in a memoir, Duane "Keefe D" Davis described the scene leading up to the shooting, wherein he obtained the weapon and handed it to the alleged shooter. Keefe D has since pleaded not guilty and claims the statements he made in his memoir and to the public were exaggerations and fabrications in an effort to sell more books.

Flock cameras are automated license plate readers (ALPR) that capture, store, and track images of your license plates, along with the make, model, and color of your car, and the time and location of when you passed. Proponents of flock cameras claim that they help fight crime. The detractors claim they are an assault on our constitutional rights as Americans, and open the doors of mass surveillance and privacy concerns in the future.

It's hard to tell at this point what lead to this change but it was clearly not an ideal sequence of events for the Mangione defense team. Luigi Mangione did it. At least this is what we can assume as his defense team refocuses their efforts to a present an "extreme emotional disturbance" defense in his state case. Even though this is similar to an NGRI, there are important differences as Nick and Tony discuss.
