#346: Is It Fire And Rehire or Fire And Replace? When Redundancy Is the Reason … and Also the Cover For You Losing Your Job! 22 Oct 202600:15:48

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

Today we're talking about something many of you are already feeling - job losses, tight budgets, and  a redundancy situation no one wants to face, which is getting closer to you because the economy is under pressure.

We get that!

But, what if the need to make redundancies is used as an opportunity to get rid of staff members who cost the company more money because they have long service histories. What if redundancies are being used to save the company money by imposing worse terms and conditions on long-service workers, to coerce those workers into accepting worse employment rights or losing their jobs.

This is what we are looking at in today’s episode.

If you have questions about how this week’s information applies to your situation, reach out to us at enquiries@employmentrightsonline.com.   And, if today's episode helped, share it with someone who needs it.

Remember, we also have detailed free downloads, grievance handbooks and grievance support and advice services available, to help you understand your position and take practical steps forward.

You can find all the links to our  books, free downloadable support tools and information about our support services all available in the show notes wherever you are listening to this podcast. Hit the live link or the ‘see more’ button and the link will take you straight to the support you need.

Finally, remember to review, follow and share the podcast - to help us get to 50 reviews and reach more people.

Until next week…

Have the best employment rights week that you can!

Bye for now.

#344: Here’s How NOT Following the ACAS Code Could Cost You Money Even If You Win Your Case At Employment Tribunal!08 Oct 202600:13:49

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there… and welcome to Employment Rights Online - the podcast.

In last week’s episode, we talked about the ACAS Code of Practice on Disciplinary and Grievance Procedures and the changes ACAS is proposing. In that episode, we explained, that if your employer unreasonably fails to follow the Code… a tribunal can increase your compensation by up to 25%.

This week we look at the same ACAS code and how that code is also a rulebook for you – the employee, and why not following the code could also lead to you having your compensation reduced  by up to 25%. We look at the six circumstances where the code expects you to act – and why!

If you have questions about how these changes apply to your situation, reach out to us at enquiries@employmentrightsonline.com.   And, if today's episode helped, share it with someone who needs it.

Remember, we also have detailed free downloads, grievance handbooks and grievance support and advice services available, to help you understand your position and take practical steps forward.

#343: The Disciplinary & Grievance Rulebook is Changing. What the New ACAS Code Could Mean for You! 01 Oct 202600:14:36

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

If you find yourself suspended on a Friday afternoon with no warning and no chance to explain… and you ask yourself… is that even allowed? In this episode of Employment Rights Online, we break down the big changes ACAS is proposing to its Code of Practice on Disciplinary and Grievance Procedures… the rulebook tribunals must use when deciding if you were treated fairly at work.

We explain why suspension should be rare, why your employer may soon need to try talking things through first, what the switch from "employee" to "worker" really means for you, and how using AI to write your grievance could be affected. With the cap on unfair dismissal compensation set to go in January 2027, getting this right could make a big difference to your pocket. Tune in… so you know where you stand.

If you have questions about how these changes apply to your situation, reach out to us at enquiries@employmentrightsonline.com.   And, if today's episode helped, share it with someone who needs it.

#342: Is Your Boss Messing With Your Parental Leave? There’s An Employment Tribunal Case For That! 24 Sep 202600:15:02

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there and welcome to Employment Rights Online… The podcast.

Today we're closing our mini series on your new parental leave rights, with the part that ties it all together, by asking, what happens when your employer refuses, postpones, or punishes you for taking parental leave.

This episode is important because employment rights on paper are a good thing.  But, enforcing your rights are completely something else… and if you don’t know when your employment rights have been breached, your situation is ripe for your employer to take full advantage of you.

However, in this episode, we talk about how two employees took action against their employer, for blocking their day one legal right to take parental leave.

If you have questions about how this leave applies to your situation, reach out to us at enquiries@employmentrightsonline.com.   And, if today's episode helped, share it with someone who needs it.

Remember, we also have detailed free downloads, grievance handbooks and grievance support and advice services available, to help you understand your position and take practical steps forward.

#341: When The Unthinkable Happens… You May Qualify For Bereaved Parents Leave! 17 Sep 202600:13:34

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there...

Before listening to this session, we want to alert you that in this week’s episode we will be having a discussion about death that is not directed at anyone in particular, but may have an effect on you that we are unaware of.  Please take this into consideration before listening to this episode and if you need support after listening to this episode, please reach out to your usual support networks.  We are also here if you need to talk.

In this week’s episode, we are talking about what happens with the mother or primary carer of your newborn baby passes away and the how the new Bereaved Partner’s Paternity Leave can help you to manage this life-changing situation.

Breaved Partner’s Paternity Leave or BPPL, is a day one employment right... providing up to 52 weeks... of unpaid leave from 6th April 2026.  To get this leave depends on your relationship to the child and to the primary carer who passed away and depends on you taking up the main responsibility for the child's care. And if you qualify for this leave, the leave must be taken as one continuous block - within 52 weeks of the birth or adoption of the child.

We go into much more detail about this leave, in the podcast episode.

If you have questions about how this leave applies to your situation, reach out to us at enquiries@employmentrightsonline.com.   And, if today's episode helped, share it with someone who needs it.

If you have been affected by the contents of this podcast, please reach out to your support group.

#340: Day One At Work And You Are Already Protected By New Paternity and Parental Leave Rights. Did You Know This! 10 Sep 202600:12:27

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

Welcome to Employment Rights Online - the podcast that keeps you one step ahead of employment changes that actually affect your working life.

Imagine starting a brand new job on a Monday morning and then finding out your partner's due date to deliver your child, is that Friday...of the same week; or, suddenly your child is ill and neither you or your partner have any leave left that you can take. What would you do?

In this week’s episode, we discuss the new changes to Paternity Leave and Unpaid Parental Rights Leave, which help to even out the playing field for working parents.

In next week’s episode, we look at the new Bereaved Partner Leave that has also just come onto the statute books – so remember to look out for that episode.

It's our view, that the more you are able to acquaint yourself with your employment rights, the more your rights will act as an early warning system, which you can use to spot bad treatment or illegal treatment that you may be suffering at work.

If you do find yourself facing difficulties at work or you need help with your grievance process, we have our FREE ‘WRITE IT DOWN’ Guide and Grievance Complaints Checklist which are available to support you.  Use these guides to help you challenge unfair treatment at work.

We also have our detailed handbook ‘Grievance Procedures: How To Use Grievance Procedures to Make Complaints and Challenge Unfair Treatment At Work’, which is available on Amazon, and will help you with your Grievance in a step by step way.

Check out the rest of our support services below.

Finally… remember to follow, review and share the podcast to help us get to 50 reviews and reach more people. We really do appreciate you doing this.

Until next week…

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

Welcome to Employment Rights Online - the podcast that breaks down your employment rights into bite-sized pieces of understanding.

In this episode, we break down exactly what's coming your way for agency workers, zero hours, casual staff, bank staff and platform workers who will now fall under ‘Right To Work’ checks for the first time. We also explain a new concept called "extended liability" which will see responsibility for getting these new right to work checks correct, can stretch further up the supply chain than ever before both for workers and for substitute workers. We end with —a practical checklist of what you can do right now to protect yourself before the new rules land.

Hi there

Welcome to Employment Rights Online - the podcast that unpacks what's really going on in the world of work, one issue at a time.

This week, in our final back office look at the whole grievance process, we look at the grievance hearing that's supposed listen and review your grievance information fairly.  And we look at those dodgy missteps your employer could make, set against a specific backdrop of where mediation has already been tried, and has already failed.

The concerns we are raising may be specific to a grievance, where mediation has failed - but in real terms, the points we raise could be applied to any grievance hearing you attend.

Whatever the case, our focus is on what to look for and what to challenge.

Hi there,

Welcome back to Employment Rights Online - the podcast that breaks down your rights at work one issue at a time.

Over the last couple of episodes, we've been looking at workplace mediation. What it is... how a session actually runs... and why it can sometimes repair a working relationship that's gone badly wrong.

Our focus is on what to do next and we’ll follow this theme through into next week’s episode – so remember to listen in to that episode.

We have our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist which are available to support you.  Use these guides to help you challenge unfair treatment at work.

Hi there

This week we’re bringing you an update about your new Unfair Dismissal Rights, which we last podcasted about in December 2025.  In that episode we told you that from 1st January 2027, anyone with six months' continuous service will be able to claim unfair dismissal. But, what we did not know then and know now, is that the government has scraped the unfair dismissal compensation cap entirely.

In this week’s episode, we share what this will mean for you and also, the likely changes your employer will be making, given your new employment rights.

If this episode has helped you understand your new unfair dismissal rights … please share it with someone else who needs to hear it.  And if you have been affected by an unfair dismissal process and your employer is not taking your concerns seriously … please do not just put up with it.

Get proper advice.

We have our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist which are available to support you.  Use these guides to help you challenge unfair treatment at work.

#330: Your Workplace Data Protection Rights Just Got New Life. Here's What You Need To Know!02 Jul 202600:13:07

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

This week we are looking at the new data protection employment rights that you gained on 19th June 2026. In fact, this right is so new, you are likely to not even know this right exists because there was no build up to it. And, what that right is – is your new employment right to make a data protection complaint directly to your employer or to any organisation that holds your personal data, where you suspect that your personal data has been mishandled.

This new right called ‘The right to make a data protection complaint’ is about your personal information - your health, your finances, your private life, etc. and how much control you have over who gets to see and use that information. This new employment right to complain directly to your employer is therefore, a positive step forward for workers and now that you know this right exists you are in a much stronger position to use it.

If this episode helps you understand your data protection rights at work, please share it with someone else who needs to hear it.  And, if you believe your personal data is being mishandled by your employer and they are not taking your data or your concerns seriously, please do not just put up with it.

Get proper advice!

We have our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist which are available to support you.  Use these guides to help you challenge unfair treatment at work.

And, the reasons why you are giving back your holidays to your boss, are worth talking about. Some of the reasons you are not taking your holidays are about personal choice. But, a lot of the reasons are about pressures at work that get in the way of being able to take time off.

#327: You Never Knew That AI Decided Whether You Got That Job. Here Is What Your Employment Rights Say About This!11 Jun 202600:17:14

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there.

This week, we’re talking about something that is becoming more and more common in the world of work and most workers have absolutely no idea that it is happening to them or that they have rights around it. We’re talking about automated decision-making in recruitment and selection, and in particular the use of AI tools in helping employers to sift, select, rule out and shortlist applications; What employers are doing wrong – and the rights you have to ensure you are treated fairly and without bias.

If you are currently going through a recruitment process… or you have recently been rejected from a role… it is worth asking the employer whether automated decision-making was used… and what safeguards they have in place. You have every right to ask that question.

If this episode helped you understand your rights around automated decision-making… please share it with someone else who needs to hear it.

If you believe your data rights have been breached in a recruitment process… please do not just move on. Get proper advice. We have Grievance support and consultation services available to help you understand your position and take practical steps forward.

Remember, we also have our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist which are available to support you.  Use these guides to help you challenge unfair treatment at work.

#325: Spent Convictions Cannot Be Used To Stop You Getting That Job. The Law Is On Your Side More Than You Think!28 May 202600:15:18

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there.

Last week we talked about everything YOU can do, practically and personally, to improve your chances of getting back into work when you have a criminal record. This week we explore the employment rights and legal protections that exist - to stop employers from simply shutting the door on you and denying you that job, just because you have a criminal conviction.

In this episode, we look at The Rehavilitation Of Offenders Act, Data Protection and GDPR and the use of Blanket Ban policies to prevent you from getting that job, when you have a spent criminal conviction. The law is not perfect and there are gaps. But the protections that exist are real and you can use them if you believe you have been treated unfairly.

Our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist are available here, to support you.

#314: Constructive Dismissal Rights and Whistleblowing Rights Can Help Challenge ‘Name-Calling’ Bullying! 13 Mar 202600:18:09

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there and welcome to the last episode in our mini series about name-calling bullying.

In the last two episodes, we’ve looked at how to challenge name calling bullying using the Equalities Act and using stalking legislation in the civil courts. In this week’s episode, we look at three powerful employment rights you can use to get your employer to take your concerns seriously and make the bullying stop. Those rights are:

Constructive dismissal;
Whistleblowing protections; and,
Breach of contract rights

Having explored each of these rights in detail in previous podcasts, we give a brief explanation of how each employment right works, and we also use employment tribunal case that show how these rights operate in real life.

We’re always interested in your views, so let us know in our comments sections on our podcast sites.

#313: When “Nickname Bullying Is Challenged Under Stalking Legislation. Here's What You Need to Know!05 Mar 202600:13:22

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

In this week’s episode, we look at how a worker challenged name-calling bullying, by taking his employer through the civil courts using stalking laws via a non-employment rights piece of legislation.

Today, the case of Majrowski vs Guys & St Thomas’ Hospital, continues to be a major player and legal decision in how your employer is supposed to handle complaints about bullying.

In next week’s final name-calling bullying episode, we’ll look at the narrow existing employment rights routes you can use to challenge name calling bullying, if you do not want to go through the civil courts - so remember to listen in for that episode.

We’re always interested in your views, so let us know in our comments sections on our podcast sites, whether nickname bullying is happening or has happened  you, and how this is being addressed by your manager.

Hi there

This week we look at the often touchy and upsetting subject of your bullying work colleagues giving you a nickname that is intended to extend their bullying of you. Many workers experience workplace bullying that is subtle, normalised, and difficult to challenge, and one of the most overlooked forms of bullying, is being given a nickname by your colleagues that you did not choose and do not want.

#311: Want To Lose Your Job Fast? He Had Four Full Time Jobs At The Same Time And Ended Up In Jail!19 Feb 202600:16:56

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

In last week’s podcast episode we talked about polygamous working.

This week’s episode is about those real UK cases and workers who held multiple full-time jobs at the same time, without telling their employers, how long they did it, how much they earned (or tried to earn), and the costly consequences that followed.

Some workers have taken on freelance gigs or legitimate second jobs.   However, other workers stepped over a line that many didn’t even realise existed - and ended up not just losing their job, but facing criminal charges and suspensions from the courts.

We look at those cases in this week’s episode.

We’re always interested in your views, so let us know in our comments sections on our podcast sites, whether polygamous working is a thing for you, and how you are making it work.

Our FREE ‘WRITE IT DOWN’ Bullying Guide and Grievance Complaints Checklist are available here.  Use these guides to help you challenge unfair treatment at work. The links are also in the show notes below.

Hi there

This week we take a look at the often controversial world of polygamous working. If you don’t know what that is, or whether this is something you are practicing, this is the podcast episode for you.

In this episode, we look at what polygamous working actually is; what the law says about you if you work in this way how you might get caught out; and how you can protect yourself if you need to take on another job in addition to your substantive 9-5 job.

We’re always interested in your views, so let us know in our comments sections on our podcast sites, whether polygamous working is a thing for you, and how you are making it work.

#309: When Your Employer Classifies You As Self Employed So You Don’t Get The Same Pay As Your Colleagues: There’s An Employment Tribunal For That! 05 Feb 202600:13:17

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

So… another week … another set of workers who are challenging their employer about their employment status. And, this week, we look at why dozens of NHS delivery drivers are challenging their Royal Mail employer because they say their employer has categorised them as self employed, when everything about their jobs, says they are workers.

The issue at stake here, is the difference between receiving a guaranteed national minimum wage after deductions – and, being expected to cover all your costs as a self-employed driver, working alongside other Royal Mail drivers who are given a fairer status for their jobs.

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

In this week’s episode, we look at a form of bullying which up to 14million of you are suffering from in the UK, as we speak. That form of bullying is called Sabotage Bullying.

Sabotage bullying behaviour is some of the most damaging bullying at work because it is quieter and harder to spot, so we take you through what this type of bullying might look like, and what sabotage bullies are likely to do to undermine you at work.

In this episode, we reference the following podcast episodes:

· Episodes 277, 278 and 287 reference constructive dismissal

· Episodes 26 and 57, which references the Equality Act 2010

·  Episode 266 which refers to a ‘Breach of the Implied Trust And Confidence Term’, and

·  Episode 302, which is one of many episodes that reference unfair dismissal employment rights.

If you are looking for specific episodes, use the search tool where you are listening, to find the episodes you are looking for.

#307: When Management Feedback Turns Into Bullying: Understanding The Impact of Constant Criticism at Work!22 Jan 202600:14:56

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

In this week’s episode, we’re looking at the impact of constant criticism at work and why this is a form of bullying, rather than you just having an over-zealous boss. We also talk about how you can tell the difference between genuine feedback, which should assist you and help you grow, as opposed to bullying feedback, which is intended to attack you and cause you harm.

The nature of a bully at work, is to make you feel so ill and powerless – you hide the bullying and try to manage the impact of the bullying experience on you for a number of reasons. What the bully does not expect, is for you to take steps to challenge their bullying behaviour.

There is a FREE ‘WRITE IT DOWN’ Bullying Guide with this week’s podcast. The link is in the show notes below.

#306: Some Colleagues Say I’m Over-Sensitive But I Feel I’m Being Bullied At Work. Here Are The Signs To Look Out For!19 Jan 202600:17:26

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

In the first of our bullying episodes for 2026, we tackle the issue of what workplace bullying really is, what it can look like, how it feels, and what you can do if you think it’s happening to you.

The nature of a bully at work, is to make you feel so ill and powerless – you hide the bullying and try to manage the impact of the bullying experience on you for a number of reasons. What the bully does not expect, is for you to take steps to challenge their bullying behaviour.

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

In this week’s podcast episode, we bring you an update about how your probationary contract rights have been affected by your new unfair dismissal rights, which come online in January 2027.

For the last 25 years, being dismissed during your probation period or even well after you finished your probation, came with very little employment rights. All this has changed, and we bring you up to date in this week’s episode.

Remember, our 2026 Bullying, Harassment And Toxic Workplace Cultures programme, is intended to support you to deal with bullying at work because bullying at work remains the number one disregulator of workplace performances and worker wellbeing.  This is what you are telling us in your comments and questions… and in the consultations that you attend.

#299: When Men Sexually Harass Other Men At Work, There’s An Employment Right For That! 20 Nov 202500:15:17

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there,

Imagine this: you're at work, trying to get on with your job, when colleagues nearby start sharing offensive jokes about women, homosexuality, and sex. The jokes aren't aimed at you directly, but you have to hear them… every day!

What would you do? How would it make you feel?

We look at this issue through a case that recently came out of the employment tribunal, which strengthens the rights of every worker, to not be subjected to harassment in general and sexual harassment in particular, in the workplace.

It's our view, that the more you are able to acquaint yourself with your employment rights in this area, the more your rights will act as an early warning system, which you can use to spot bad treatment or illegal treatment that you may be suffering at work.  If you need help to formulate your complaint you can download a copy of our ‘Complaints Checklist’ here.

#298: Calling You Names Then Suddenly Sacking You. There’s An Employment Tribunal Claim For That Behaviour! 13 Nov 202500:13:27

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

This week, we look at a case that has just come out of an employment tribunal, which helps to strengthen the rights of workers when a boss crosses the line with a comment that feels, just – wrong! And as if that was not bad enough, that comment then turns out to be the start of a whole process of trying to get rid of you, to avoid you getting your full employment rights.

We deal with all this, in the podcast episode.

#297: Online Workplace Chat Groups Can Get You The Sack. Here's Why!06 Nov 202500:15:09

Leave comments and questions here. If you would like a response, use our email: enquiries@employmentrightsonline.com

Hi there

This week we look at a case that has just exploded into the headlines, that seems to strengthen the hand of employers dramatically when workers band together to talk about problems you are having at work. It’s a case about pay cuts and a private WhatsApp group, and focuses on how you can be in an online chat group talking about work issues, and then suddenly find yourself facing the sack, for breaching company policy.

We look at your employment rights in this situation, and why employers are coming after workers in online work-related chat groups.
