Imagine this: you're at work, trying to get on with your job, when colleagues nearby start sharing offensive jokes about women, homosexuality, and sex. The jokes aren't aimed at you directly, but you have to hear them… every day! 

What would you do? How would it make you feel?

We look at this issue through a case that recently came out of the employment tribunal, which strengthens the rights of every worker, to not be subjected to harassment in general and sexual harassment in particular, in the workplace.

This week, we look at a case that has just come out of an employment tribunal, which helps to strengthen the rights of workers when a boss crosses the line with a comment that feels, just – wrong! And as if that was not bad enough, that comment then turns out to be the start of a whole process of trying to get rid of you, to avoid you getting your full employment rights.

What if, in a heated moment, you actually called your boss a Dickhead? Surely, that would be an instant reason for your marching orders and dismissal for gross misconduct, right? Well… not necessarily!

This week we take a look at a recent employment tribunal case which has shocked the legal and employer worlds, because it involves and employee who used this abusive term towards her employer. The employee was then sacked on the spot, took her case to an employment tribunal and was found to have been unfairly dismissed.

 In last week’s episode, we looked at the major differences in the employment rights, between someone who is self-employed and someone who is an employee or a worker. 

In this second episode of the miniseries, we focus on why the key principle of ‘secondment’ is a deal breaker for your employment rights, using the recent Supreme Court ruling that decided that Deliveroo food delivery riders are classed as self-employed whilst Uber taxi drivers are classed as workers, who now get basic employment rights.

In this week’s episode, we take a look at the battle raging to prevent you from working a four-day week, if you work for a local authority. There are lots of private sector businesses and workplaces that have long since adopted a four-day work week – because of the huge benefits gained on workforce development, particularly at a time when there is competition to recruit and retain the best staff into the workforce.  However, it seems that the same approach to recruiting staff – with a four-day work week benefit, is not a welcomed approach in your local council.

Overall, not much has changed, but the changes that have been brought forward are important for you to know at this stage, because if we get all these changes in the final employment rights bill, your proposed new employment rights will represent the biggest shift in UK unfair dismissal rights in decades… and will definitely add to your job security in the workplace.

In our last podcast episode about references, we look at the specific cases of reference refusal linked to discrimination and whistleblowing, and the key points you need to have in mind, when thinking about making a complaint to an employment tribunal.  We look at the important role played by the ‘Continuing Act’ principle, in discrimination cases… and we also look at the role of ‘Disclosure, Detriment and Causation’ in whistleblowing cases.

Did you know that if you are under 18 years of age, your right to rest breaks at work, are not the same as those for adults. We hope you are able to access your employment rights at work, to provide yourself with some security in these uncertain times. Don’t be put off into thinking there is no point. This is exactly what your employer wants you to think!

This week, we ask a key question.  What’s happened to your lunch breaks and tea breaks!  To answer this question, we take you through the three legal rest breaks you are entitled to as part of your employment rights. 

Some of the information in the podcast, might shock you, but after you have picked your chin off the floor, head straight to your contract of employment to check what is written in that contract, about your legal breaks.

This week we look at new guidance which was released by ACAS on 20th April 2023,  which aims to support you to get reasonable adjustments from your employer when you're mental health is a feature in your daily life - because this duty already exists under the Equality Act 2010. But what's new , is the guidance now asks employers to extend this good practice to when general unwellness and sickness affects all employees. Why? Because it's good practice for employers to show they are caring for their workforce. 

The new ACAS guidance is now in play and you can use the guidance to encourage your employer to take a broader view to making reasonable adjustments at work for you, when you are unwell - even if you don’t have a disability.

Just when you think you have no protection at work, from the bad treatment you are suffering, along comes an employment right to level the score. However, to get even, you need to know your rights and use your rights. We are here to help you with that. 

In this week’s episode, we talk about the new tipping law called ‘The Employment Allocation of Tips Act’ which has just come onto the statute books. When this new law is in full working order, the law is set to positively revolutionise the way in which your tips and gratuities are going to be paid to you. The new law will instruct employers in the hospitality industry, to pass on 100% of your tips and gratuities without any deductions.  This law will come into practice in 2024.

This is the final episode in our Unfair Dismissal series and in this week’s episode, we are going to look at what happens when you win your case for unfair dismissal at an employment tribunal, but the tribunal says you contributed to your own dismissal and punishes you for that, and takes reduces any compensation you receive, by between 10% and 100% of your compensation.  We also use two key employment rights cases, to show you, how your employer will ask a tribunal to reduce your compensation. Having spent several weeks looking at coercive dismissals, we would be failing you if we didn’t look at one of the most complained about issues for UK workers following dismissal. That issue, is the issue of securing a reference from your last employer, when that employer has dismissed you from your job. A ghost job is a job posted by an employer, which the employer may or may not fill with a successful applicant, without telling the applicant.
