London Central employment tribunal announces a member has staff has tested positive for Covid-19.

The President of Employment Tribunals (England & Wales), Judge Barry Clarke, issues three new guidance documents.

First is the Presidential Practice Direction on the use of the Welsh Language. This reminds tribunals in Wales than any witness or participant who wishes to use Welsh rather than English is entitled to do so in tribunal proceedings.

Second is the Presidential Practice Direction on remote hearings and open justice. This sets out the way that open justice should be preserved during remote hearings, for example by witness statements being put up on screen or read out by the witness.

Third is the Presidential Guidance on remote and in-person hearings. This sets out the factors to consider when deciding whether a hearing should be remote, partly remote, or in person, and gives guidance on how parties should prepare for remote hearings (including guidance on lodging documents). It also sets out safety factors for in-person hearings.

S1E58 - Unconscious Bias: My training story11 Jul 202000:07:41

In this episode, Daniel Barnett explains why he’s doing unconscious bias training

Everyone has biases and we can't get rid of them. So this is not about being in the wrong. On the training session, Selwyn Blyth will raise your awareness of the (unintentional) impact of bias - and offer practical suggestions for how to minimise the negative impact at work. 

A lot of the learning comes from watching and interacting with scenes delivered by professional actors based on real-life workplace events. You can influence what happens by suggesting how they adapt their behaviour [no role play is required]. This "forum theatre" approach brings the issues to life. 

There will also be panel discussion, interactive chat and polling during the session. You won't feel lectured - our aim is to engage you. 

The training is split into three parts.

The first part involves theory around cognitive  biases and heuristics (mental shortcuts).  We'll include some tests where you are shown pictures of people and your instinctive biases are measured, so you can discover whether you are ever susceptible to unconscious bias.  We'll learn about affinity bias ('mini me') and confirmation bias ('halo or horns').

The second part involves role playing and practical exercises.  Selwyn will, together with two actors, use 'forum theatre' to present different scenes.  The first is a (male) manager mishandling a case of poor performance.  The second scene is based on a man in his late 40s making a request for  flexible working to look after a child; this is mishandled by a (female) manager.

You watch the scenes without interruption and then, through online feedback and discussion (volunteers only - nobody picked on) you will faciliate feedback for the manager on how to handle the situation better.  The actors replay the scenes taking on board the feedback, and you can interrupt with suggestions in the online chat box if you are not happy with how it is progressing.

The third and final section of the course explores four strategies for reducing the impact of bias: (1) challenging commonly held stereotypes  in an organisation; (2) seeking situational reasons for outcomes; (3) changing perception of relationship with out-group  members; and (4) being an active bystander.

S1E49 - Notice Pay while on Furlough27 Apr 202000:22:52

Employers are entitled to give notice of termination (whether on grounds of redundancy, or otherwise) to employees who are on furlough.  Salary payments made by the employer during furlough can still be reclaimed from HMRC (subject to the limits of the Coronavirus Job Retention Scheme), despite the employee working out notice.

An unresolved issue is: if employees have agreed to accept 80% of their salary while on furlough, is their notice pay also paid at 80%, or does it revert by operation of law to 100%?  Remarkably little has been written on this, in part because such a simple question entails an extremely complex analysis, and in part because even with that analysis, the answer remains opaque.  

This podcast argues that despite the established statutory rules, which lead to the answer ‘it depends’, a court or tribunal would strain to ensure that an employee receives 100% of their normal pay during notice period – even if they have agreed to accept 80% - and there are a number of devices a court could use to achieve that outcome.

Unless the employer has taken ‘all reasonable steps’ in advance to stop any sexual conduct from happening, an employer will be liable for one employee’s harassment of another. Tribunals can be reluctant to allow an employer to escape liability because it leaves the employee without any meaningful recourse. The question then is, how do you demonstrate ‘all reasonable steps’?

S1E32 - Two Supreme Court Cases for 202011 Feb 202000:26:16

In this episode, Daniel Barnett predicts the outcome of the two big Supreme Court cases of 2020 in discussion with employment law speaker Darren Newman.

First, they discuss The Royal Mencap Society v Tomlinson-Blake, due to be argued in the Supreme Court later this week, which will consider whether ‘on-call’ workers at care homes are entitled to be paid the minimum wage for periods when they are on call (ie available for work, but not actually working).
 
Second, they discuss the Uber case, Uber BV v Aslam.  Uber lost in the employment tribunal, EAT and Court of Appeal, with 4 out of 5 judges over those stages holding that Uber drivers are ‘workers’, and thus entitled to minimum wage and holiday pay.  Will the Supreme Court take a different view later this year?
