But like every generalization, the facts will tell you the actual story that this is not always the case.

Podcast host Mike Haltman was introduced to JT through the social media platform X aka Twitter, and more specifically on X the hashtag there #retwit.
The 'members' of the #retwit community on X comprise some of the biggest national names in CRE who work in many different areas and sectors of the commercial real estate market including investment sales, insurance, development, construction, cost segregation, leasing, finance, and so much more.
JT Marting, going by the moniker Real Estate Rookie on X, is a student at Florida State who throughout his college career has done significant work and learning as an intern at six real estate firms in various areas and sectors.
Through the generosity of Geoffrey Stevens who has set up an organization that provides scholarships to Florida college students who show an interest in the real estate industry, JT has been able to further his real estate education and at the same time continue to make great connections!
But by participating on X, JT has met and become close to some of the biggest names in CRE like The GOAT Bob Knakal, Dan Tepman (Strip Mall Guy), and serious up-and-comers in commercial real estate such as Faraz Cheema.

New York City's Population Is Dropping 2.49% Annually!
That's a big number with the percentage change from 2020-2024 sitting at 9.26%
We know that the reasons for leaving range from cost of living, crime, overall quality of life, and most certainly, the invisible hand of state and local governments taking an ever-growing amount of money from us through taxes.
So where are these former New Yorkers going? Many are going to states with more reasonable taxing policies including Florida, Texas, Washington, Wyoming, Tennessee, Alaska, South Dakota, and New Hampshire.
But establishing citizenship in another state is not as easy as living there, with serious proof, for 6 months and a day per year.
These state governments facing a loss of population do not take the situation lightly, and will jump through hoops to disprove your new domicile claim.
You Need To Consult With An Expert!

In our conversation Marisa and I touched on many subjects surrounding the emigration to other states, along with what has to be proven to the auditors so that no demand for taxes is made.
Change of domicile...
The burden of proof falls on the taxpayer, not the government, and for New York State five primary factors need to be proven for the domicile to be considered changed...
Home: An auditor's examination of an individual's "home" will consider the person's use and upkeep of their New York residence in comparison to their residence outside of New York. When a taxpayer purchases a new home in another state and maintains multiple residences, including at least one in New York, this factor becomes more complex to assess. In ambiguous cases, an auditor will evaluate the use of multiple homes based on the following criteria: (a) size of the residence; (b) value of the residence; (c) nature of use; and (d) other relevant home features.
Active Business Involvement: Taxpayers who are heavily involved in or have substantial investments in a New York trade, business, occupation, or profession will find this factor challenging during an audit and should prepare accordingly.
Time: This factor involves analyzing where and how an individual spends their time throughout the year, comparing the time spent in New York with the time spent elsewhere.
Items of Sentimental Value: This primary factor seeks to identify the location of items with significant sentimental value, such as family heirlooms, artworks, book collections, and personal items that enhance quality of life.
Family Connection: Due to its intrusive nature, the "Family Connection" factor is only considered when the first four primary factors do not clearly and convincingly indicate the taxpayer's intent. This factor generally focuses on the taxpayer's immediate family, such as a spouse or partner and any minor children. A key element is the location of the schools attended by the taxpayer's minor children.

A Charity Working To Help Cubans Living In Poverty!
'According to a 2022 report from the Cuban Human Rights Observatory (OCDH), 72 percent of Cubans live below the poverty line. 21 percent of Cubans who live below the poverty line frequently go without breakfast, lunch or dinner due to a lack of money.'
And while many people in America are suffering in much the same way, for Cubans who have come to the U.S. the plight of their brethren who remain in Cuba is often top of mind!
Enter Chazz Menendez who came to America in 1963 with his pregnant mother, as the still unborn child she was carrying.
Chazz, in the spirit of giving back to the United States volunteered on the World Trade Center pile for two days, September 12th and 13th 2001.
After adopting two sons, he was forced to retire from his career as a stunt man due to WTC pile-induced Stage 4 brain cancer.
But wanting to give back to Cuban citizens living in poverty, he recently founded the charity SupportCubans.Life with the tagline 'People Caring For People'.
In it, Chazz describes what SupportCubans.Life does, and how you can help.
This is the Mission Statement, '“SupportCubans.LIFE” is a grassroots, humanitarian nonprofit organization that raises money for our team of volunteers to travel to Cuba and also asks people to donate used and new essential products and ship these donations to our storage facility so that our team of volunteers can hand-deliver these donations. Our travel team member volunteers visit and stay in these impoverished areas to connect with these communities on a personal level and to make sure the people receive these donations.

Today buyers are facing the proverbial 'seller's market' despite the fact that 30-year mortgage rates have climbed from the Covid-era 2 % or 3% handle to the current 6%+.
Lack of home inventory is a key factor!
On March 20, 2024 when the Federal Reserve's Jerome Powell speaks post-Fed meeting, the real estate market will get more direction concerning where mortgage rates head from here.
That being said, potential purchasers need to put their best foot forward when making an offer and besides the price, sellers will look to make sure that a mortgage will not stand in the way of closing the transaction.
One alternative is to pay cash, but if a mortgage is being arranged it is critical to work with a lender AND a loan consultant who knows how to get it done!

Currently a security consultant in the private sector, and a Visiting Fellow at The Heritage Foundation leading the Foreign Policy, Homeland Security, and Defense Team.
In other words, Steven Bucci is an expert and completely fluent in the areas of homeland security, defense, cybersecurity, terrorism, and geopolitics.
Prior to our discussion we had a list of nine global issues to speak about but, because we were constrained by time and still went to 42 minutes, we barely got through four of them.
The first topic, given that Steven Bucci is a former Deputy Secretary of Defense, is a discussion concerning the disappearance of Secretary of Defense Lloyd Austin at a time when the world is on fire!
We spoke about the old cliche of 'What keeps you up at night' given the plethora of issues facing the United States and the world.
Of course the southern border was discussed, given the fact that it is an open portal for anyone in the world who wants to cross over. This means it's an issue of incoming deadly drugs, potential diseases, people with criminal records, and individuals on the terror watch list. Not to mention the human tragedy facing women and children.
We spoke about the crisis in the Middle East centered around Israel, and whether leadership in the U.S. is sending the right message with our military reaction.
The last subject that we spoke about is the potential for the U.S. energy grid to be shut down by cybercriminals or an EMP attack.

Father Peter Pomposello...Priest, Paratrooper, and Pathfinder! Do You Ever Wonder?
Starting his career in the Reserve Officer Training Corps and as a schoolteacher, Father Peter spent much of his time at Our Lady, Queen of Peace on Staten Island, and at the age of 28 decided to dedicate his life to serving the Lord in the Eucharist.
Now he has been in the Army for 8 years as a priest first and a soldier second! However getting to the Archdiocese for the Military Services in the first place required the permission of his bishop, Cardinal Timothy Dolan who graciously gave it to him.
He has been deployed to combat zones in Iraq and Syria, and has jumped out of planes with paratroopers in Alaska.
In his far-reaching role in the Army, Father Peter has also had to say prayers for soldiers who died in combat, blessing their bodies before they made their ‘angel flight’ home to their family and loved ones for their funerals.
Father Peter also serves the U.S. Army in the role of priest recruiter. His mission is to bring more Catholic priests and seminarians to serve as chaplains in the Army and Army Reserves.
Currently, only 90 priests are serving in the military, with another 310 needed.
The conversation touched many subjects, not the least of which is the current conflict between Israel and Hamas, coupled with the severe moral injury likely being experienced by a great many soldiers.
This subject led us to the Heroes To Heroes Foundation, where podcast host Michael Haltman serves as Board Chair. HTH deals with U.S. soldiers suffering moral injury, with Team journeys to Israel a key part of the mission's success.

The competition office building owners face due to 14 million square feet of new modern office space soon to be on the market, but at the same time, the benefit of 1/2 the office space in New York City being obsolete.
All of this in the face of an office vacancy rate in NYC of 22.7% in August.
BGO has been using the concept of MIRO to deliver pre-builts that are “tech- and hybrid-enabled, emphasizing human-centric design to encourage adaptability, wellness, and collaboration.”

For 70%, What Happens When Rental Income = $0?
70% of multifamily building owners in New York City are not the 'fat cats' that many people think of when looking at the Super Tall apartment buildings now dotting the NYC skyline!
70% are considered 'small' owning one or two buildings, with under 50 units.
And then we have an owner like one of today's guests who came here from Britain and owns one rental unit on Staten Island. And, were it not for her incredible fortitude and work ethic, she would have lost that property.
Our two guests...
Meet Emily Barlow: A landlord of one unit with a tenant who did not pay rent and refused to vacate the property since 2019. Emily worked 100 hours a week to fulfill her obligations on the right side of the equation below and fought for eviction in a court system that tends to be very tenant-friendly.
Meet Ann Korchak: Ann is also the owner of a multifamily building in Manhattan that has been affected by the overall political, legislative, court, and Covid mandates enacted by NYC and NYS. Ann is also the President of SPONY, the Small Property Owners of New York which is an advocacy group with about 600 members.
The Simple Multifamily Formula
Rent - Expenses = Net Operating Income (NOI) Mortgage Insurance Utilities Taxes Maintenance
So what happens to landlords like Emily when the rent becomes $0 and yet the expenses still need to be paid or else the building could be lost?
Certainly, during Covid some help was available for some through programs like ERAP (Emergency Rental Assistance Program), but in many ways, she was on her own.
Owner Headwinds
Legislative: Laws that seem benign and good for tenants may ultimately work in reverse if building conditions are allowed to decline. One law that comes to mind is the NYS 2019 Housing Stability & Tenant Protect Act which put serious restrictions on owners vis a vis rent increases and benefits for doing renovations on apartments and common spaces. Another, for buildings greater than 25,000 sq. ft., is NYC Local Law 97. Good Cause Eviction being bandied about in Albany is another piece of legislation that would be detrimental for owners (Do You Ever Wonder spoke with Alexander Lycoyannis about Good Cause Eviction here https://youtu.be/1qlQwRabW54?si=2mbs1VHpkOQe2dN8).
Political: For politicians in New York State and New York City who will typically pander to one side or the other in a conflict/dispute, there are many more tenants than there are landlords giving some clue to which side of the argument they will be on.
COVID-19: Rent/eviction moratoriums were necessary for some, but for the landlords their bills (see above) still had to be paid!
Courts: Actually trying to evict whether during Covid or at any other time, the courts tend to be very tenant-friendly.

The delay occurred because of Cathy's involvement with the Multiple Sclerosis Society fundraising event at Belmont Park which brought in $600,000 of donations! Mike Haltman, whose mother suffered from MS, was thrilled to wait!
Cathy hails from Scotland about 15 minutes from the Old Course at St. Andrews, and she came to the United States in search of a career in finance, and then real estate finance.
And judging by the trajectory of Cathy's career, she has achieved incredible success in a relatively brief amount of time!
The conversation between Cathy and Mike traversed a wide range of subjects including CRE sector analysis, the current state of CRE deal financing, loan underwriting standards, the political landscapes impact on commercial real estate (i.e. Blue vs. Red), the impact of social media on the CRE industry, the importance of networking, podcasting and much more.

The 1031 Exchange - A Phenomenal Financial Planning Tool For Building Owners!
And this discussion with Rob Pecha explains it all!
Walking down the street in New York City, or in any city or town across America, there are commercial properties everywhere you look.
When the owners of those buildings sell, is it the best financial decision to take the proceeds and pay the taxes due? Or is there another way to defer those taxes, while investing the sales proceeds in 'like kind' properties?
Of course everyone's fiscal situation is different, but a 1031 Exchange presents the opportunity to continue to own property while benefitting from both the potential income it throws off and the potential for price appreciation.
And, if held onto until the owner eventually passes on, there is a step-up for heirs to the current market price.
If someone chooses to execute a 1031 Exchange, there are strict rules to be followed, or else a taxable event will occur. And in the process there is a need to use a fully vetted intermediary who will hold the sellers proceeds.
There are also alternatives to the outright ownership of another building(s), and that is through a passive 1031 Exchange known as DST's, or Delaware Statutory Trusts.
This style of 1031 Exchange eliminates the 3 T's of management - Tenants-Toilets-Trash!
DST's provide monthly income and the potential to participate in any appreciation. Here too, total vetting is critical because like in anything else, there are great operators and not-so-good ones.
All of that said, meet Rob Pecha, known as the '1031 Exchange Quarterback', who knows the 1031 Exchange business inside and out, and is a trusted advisor to a great many people.
