The National Association of REALTORs was in the news last week concerning two policies. One was changed and the other was upheld.   

First, NAR voted to end the requirement of NAR membership to gain access to REALTOR owned MLSs. This is a great policy change but did the change go far enough?

Secondly, NAR failed to approve the required disclosure of referral fees in a real estate transaction. This is a very bad look for the Association especially when you hear the amount of support in the Association for the change.

This week begins the Sitzer/Burnette trial on cooperative commissions.  Just in time for the trial, the Wall Street Journal, formerly a pro-business, pro-capitalism, and free-market newspaper, published a pathetic hit piece comparing REALTORs to cartels. Why stop there? Why not add Nazi and fascists? If you are going to use inflammatory language why not use the trifecta? 

This ridiculous article demonstrates that the Plaintiffs and mainstream media have no idea what you all do for a living or how the system works for the protection of the parties.   They certainly don't know or perhaps don't care how this will affect homebuying negatively in the future.

Today, I break down the WSJ article as well as the RE/Max and Anywhere settlements.

Many, if not all of you, are familiar with MV Realty's "Homeowner Benefit Program"  that pays the homeowners a small sum of cash in exchange for what amounts to a 40-year lien on the property. This lien requires the homeowner and all future owners to use MV Realty as the listing agent for the entire 40-year term and contains stiff penalties for failing to do so.  Luckily, these may be coming to the end as MV Realty made a huge move that may spell the end of this arrangement.

Builder and seller agent incentives are a big problem in our industry today.  Should the agent get an incentive simply to show a house or should that incentive go to the buyer?  Don't you have a fiduciary duty to do what is in the client's best interest?  How is it in the client's best interest for you to get a bonus for steering them to a house?  Doesn't sound too client centric to me!

Today, I will discuss the complexities surrounding builder and seller bonuses and incentives in real estate, particularly in light of the Sitzer Burnett case. I will explore the ethical implications of commission steering, the fiduciary duties of agents, and the legal truths that govern real estate compensation. The Central Carolina REALTORs Association has amended its' sales contract. The contract that will go live near the end of September 2025 and includes new provisions on agent compensation, seller transaction costs, authority to sign and home warranties.  

Finally, compensation is in the contract where it should have been the past year. Hopefully this will stop the numerous problems in how agents document compensation.  Check out this week's episode to learn the changes and what the changes mean to you and your clients.

Today, I will discuss the implications of the first anniversary on the real estate industry. I will address the misconceptions surrounding the settlement, the impact on commissions, and the ongoing strength of the Realtors Association. One of the biggest issues in the real estate industry today is the lack of knowledge and understanding of agency.  Today I examine and answer the questions of what can you do and not do without agency?  How can agency really be terminated?  How far do you have to go to ensure your consumer is not under agency with another agent? I guarantee that there is a least one or two items here that will surprise you.    Agency is not easy.
