Transfer Tax Planning With Regulatory Discounts02 Jun 202300:20:03

Brent chats about how discounts abound in transfer tax planning (estate and gift tax)! Although sometimes discounts come from ownership of entities, like FLPs, that is not always the case. Charitable Remainder Trusts, Charitable Lead Trusts, Grantor Retained Annuity Trusts, Private Annuities, and Remainder Purchase Marital Trusts, all use discounts that are required in the Internal Revenue Code and the regulations. These discounts can be substantial and helpful depending on the 7520 rate. Brent discusses the latest topics in international estate planning. As an estate planner, it is crucial to keep in mind that your clients are human, with concerns about managing incapacity and death, regardless of their citizenship or residency status. However, for world travelers, the complexity of estate planning increases significantly. Brent discusses five things to keep in mind when planning for the international client:

  1. Remember you are dealing with a human. Adequate powers of attorney, trusts when appropriate, wills or other testamentary instruments are just as important for non-citizen non-resident clients as they are for citizens and residents.
  2. Don’t assume what works here will work in their home jurisdiction. The world is complex, and foreign legal systems are often sophisticated. It is crucial to consult with a competent professional in the client’s home jurisdiction.
  3. Check if there is a relevant tax treaty for income or transfer taxes. In some cases, tax treaties can rewrite the rules that ordinarily apply.
  4. Carefully review all property your client owns in the US. Some property here is not subject to estate tax for non-residents, while some is. It is important to understand the difference, which can often be illogical.
  5. Don’t forget to ask about where all relevant family members are resident. Estate planning for non-citizen non-resident clients often requires planning for the laws of multiple countries, which may require a team in multiple countries to properly plan and coordinate.

By keeping these five things in mind, estate planners can provide valuable advice to world traveling clients and ensure that their estate planning goals are achieved. As you plan for your clients, remember that estate planning for world travelers requires unique consideration and attention to detail.

He launched professionally with Press-One Customer Care back in 2010. Alex managed relationships with multiple publications throughout the states to help them implement and optimize their marketing, advertising, sales, and customer service at a much lower cost than in-house solutions. This was on the tail end of the recession and the launch of the iPhone in 2007. Many print publications were struggling to balance budgets and keep up with the push to digital which is where he made his impact.

In 2015 he decided to pursue digital marketing exclusively and accepted a role at a SaaS company. He started his role working directly with 100s of businesses to help them develop and scale their digital marketing strategies and reach their growth benchmarks. Alex quickly moved up to be a Director of Marketing where he managed a team of 45 digital marketing experts and was responsible for aiding the team to develop and execute successful marketing strategies. During his time there, the company grew from under 200 employees to just over 600.  

Alex is also the co-founder of Grit Investments, a capital investment company in Northern Colorado. 

The most important part of Alex is his life outside of work. Family and faith first. He has an amazing and successful wife Alyssa and a beautiful baby girl August. They live in Windsor, CO. They love their friends and family and the most important thing to them is relationships and helping people.
