Crime On The Road. When you have a concealed carry permit, you don't have the right to pull your gun out to scare people. It is not a Lisence to bully people. In fact, a Lisence to carry a gin bares more responsibility to the person that possesses it. Recently a trucker pulled a gun out and pointed it at a motorist. It sounded like there was road rage going on prior to the incident. A car cut the truck driver off coming into a construction zone and thats when the trucker acted. The driver in the car called 911 and the trucker was arrested. He is now facing up to 25 years in prison. When obtaining your carry permit, we are told to never pull a gun out unless we intend to use it. It is not a deterrent to end an argument. Many people have been arrested because they have misused the privilege they have been given. How Does A Trucker Get Picked For Smuggling Recently we talked about a trucker that was nabbed for smuggling illegal immigrants. over 50 people died in his reefer trailer, which had shut off without him knowing. He is now facing life in prison, along with the mastermind behind this horrific crime. We were wondering, how a trucker even gets the offer to do such a job? We all know that the average person will never even get the opportunity to smuggle humans in a tractor trailer. The reason they won't be asked, is because most truckers don't associate with kind of criminal element. The only truckers that will ever get an offer to do such things, are those of the baser sort. Many drivers have told TalkCDL their last paycheck from the previous company was stolen. That's right, a driver considers his pay stolen when he does not get his earned wages. Is it Legal to Dock Pay for Poor Performance or for Mistakes? Generally, no an employer cannot engage in docking pay or fining employees for poor performance or mistakes, shortages, or damages. However, if the employee agreed in writing that a deduction could be made, the employer may be able to do so. Only when an employer has reason to believe that the employee was responsible for the mistake and the employee agrees in writing that they will pay for the mistake can it be deducted from their pay. There's No More Diesel Left Time To Panic. The United States of America uses 128 million gallons of diesel fuel per day or just over 3 million barrels. Experts are telling us we have only enough to cover the next 25 days. How did this happen? How much trouble are we really in? Blame is being cast on the Russian/Ukraine war and of course the past couple years worth of covid problems. These two issues alone have hurt the world supply chain and its not getting better fast enough. Last year alone we consumed over 1.1 billion barrels of fuel and we are on track for another billion plus. Tune into this weeks podcast and hear our take on this. A new trend in the trucking industry Truck drivers are using carriers to catch a ride to a destination they need to reach. The new scam goes like this. A driver gets hired in some distant city in the country. The new carrier does not offer a free ride to orientation. They tell the driver, he needs to fine his own way to his new job. The driver then applies with another carrier in the same area of the desired carrier. Once approved by the second carrier, the driver is offered a plane ticket to come to the new companies orientation. Once the driver lands in that city, he calls the original carrier and goes to work. Meanwhile screwing the new carrier that paid for his plane ticket. Carriers are fighting back. Some carriers are now reporting a driver to DAC or other agencies for "theft by deception of company funds". Meaning they now have to explain to any future companies why a carrier has put them down as a thief on record. This of course will hinder a driver from future jobs. Truckers Make The Best Husbands. The national average for divorced people in the United States, is, almost 50%. Yuk, right? Almost half of everyone that gets married, will get a divorce. If you get married a 2nd time, there is a 60% chance this marriage will fail. A 3rd time getting married? 3 times and you are out. 73% of people that get married a 3rd time, end in divorce. So how do truckers fair out? Truckers are at 19.14%! What? Did I just say that? The answer is "heck yeah". Truckers don't even come close to the national average when it comes to splitting ties with your spouse. In fact, truckers make the best husbands. They are loyal, romantic and go the extra "mile" to keep their significant others, till death due us part. You would think, long distant relationships would not work, but some how some way, the American trucker has found a way, whether it be through the case of love or what not, they found a way to out last the average married couple. Does absence make the heart grow fonder? It appears so. Vengeance On The Road. Recently a trucker took out his own vengeance on a trucking company. A driver started burning semi trucks that belonged to Swift transportation. In all, 25 semi trucks were torched. Im not sure what this 64 year old trucker was thinking but he was on a roll. You would think that there was cameras watching. AB5 uses a test called "the ABC" test (A) The work is done without the direction and control of the employer (B) The work is performed outside the usual course of the employers business (C)The work is done by someone who hastier own, independent business or trade doing that kind of work These three factors, decide whether a person is an employee or an independent contractor. Drive Monkey Drive. Autonomous maker Locomotion is teaming up with Stevens Trucking of Oklahoma. Steven has plans to acquire up to 500 autonomous rigs. Although fully autonomous vehicles will not be out for a few years to come. Stevens allegedly will have a pilot program some time in 2023. The Autonomous Relay Convoy or ARC systems allows two vehicles to operate together at the same time.This is done by tethering the vehicles together. What this means is, a lead driver inside truck number one, will be awake and in the drivers seat. The lead truck will be controlling the trailing vehicle. This will allow the driver in truck number 2, to get sleep, awaiting his turn to drive. I don't know about you but taking a nap, inside a vehicle that no one is driving. Doesn't sound like the safest way to travel. I believe my sleep could possibly be interrupted by the nightmare of crashing, due to, maybe, a recall on the chip thats controlling the rig. Im just not convinced that most drivers can even get well deserved rest while another machine is controlling the vehicle Im suppose to be sleeping in, while it is in an entire different vehicle. When team Driving Ends Bad. Recently a team driver, shot his co-driver while in Texas. The victim then called 911 and reported the incident. Can you only imagine how that relationship must have been? This, many times, a team ends bad. Not necessarily with one of the team members shot but relationships don't end unless they are bad. So the perpetrator got into a police chase and ultimately ended up in a shoot out with police. That's right, I said a trucker was in a shoot out on the side of a road, with police. The trucker in question pulled his big rig to the side of the road and exited the semi with gins a blazing. He did not survive. After all, if you shoot at ten policemen, you should not have too guess how it is going to end. Team driving can be a nightmare. Many times when traveling inside a tiny space, living together in a sense, 24/7/ nerves can be tried and patience can be tested. Most teams in a tractor trailer, know one another. Many time over, a team consists of a husband and wife or a brother and brother or even a friend and a friend. These teams tend to last longer than a team, that is made up of two strangers. There are companies that with team two people up, that have never met prior to orientation. This can be a disaster when the two have nothing in common. For example, one might like it warm in the truck and the other, cold. One might want to smoke and the other, not. There are many issues that can set off a war inside a semi. All issues should be taken into consideration before teaming tow people up. Stop Pleading Guilty To Traffic Violations. Why do truckers and the general public keep agreeing with the police? When you get a ticket, you are still innocent till proven guilty in the USA! So why do you just pay the ticket and go about your business? I'll tell you why. Because it is convenient to just get it over with. Plus you feel you can't win in court. Especially against an officer of the law, right? Wrong! Did you know that, in the long run you suffer more when you plead guilty? Did you know that certain tickets can cost you a great job in the future? So why are you just giving up so easy? Look, the easy way is to just send the state money and admit to your guilt and the hard way is to fight it. Time is money right? Worst Trucker plus A Story to Make You Cry. We recently sat down with, possibly the worst trucker ever. What we mean by "worst trucker", we mean worst attitude. Troy say and talked with an entitled driver, that thinks everyone owes him something. A driver called in on one of the show lines recently to rant about dispatchers and carriers. He went on to express discontent for most trucking companies. He then revealed what Troy thought was the real reason for the call. He said "no one will hire him because he has an abandonment on his record. He then told us how other carriers are blackballing him. He mentioned two carriers that Troy knows personally. So of course, Troy volunteered to call the companies and find out why these carriers are saying bad things about this disgruntled driver. So long behold, we got ahold of both of these companies. The first company told us the story behind the bad reference. This reference by the way, is for all carriers that inquire about his driver reference. They went on to tell us how, the driver took his first dispatch, after orientation. Went home with a full load and sat for a week in his home town visiting friends. They then revealed to us how the driver was in an accident while bobtailing around town. This of course added another week to the truck sitting. Not to mention the customer that was waiting for their freight. At this point the driver was asked to bring a new load straight back to the terminal. I believe the driver figured out the company was most likely going to fire him. So, of course this is where the abandonment came from. Boom, there ya go! A horror story from a trafficked victim A story came out of TAT (Truckers Against Trafficking) this week. A woman wrote how she was a victim but not like the kind most think of. She was victimized by her very own daddy. Thats right, her own parent was pimping her out as far back to when she was 5 years old. Tune in and hear this heart breaking story and more. There were other factors that determined whether you had sleep apnea or not, but it was rough on drivers that were overweight. Americas View of Truckers. I came across an article that depicted the trucking industry and the American Trucker as just pure criminal. The article showed how most people view truckers and their lifestyle. I had forgot how the public looks at you, when you tell them you are a trucker, until I read this story. You would think, the public would respect what men and women go through every day in trucking. But it is just the opposite. They dont honor the men and women that stay on the road for countless weeks and months at a time. It's just the opposite. They're opinion is, most of the times, low, mixed with fear of the working class road warriors. All this animosity towards truckers just might be something we brought on ourselves. You heard of "one bad apple spoils the whole bunch", right? Well, this goes for trucking also. Most truck drivers are not bad people, we give respect and are watching out for the general public on the road. But all you need, is that one guy, thats driving reckless with 72 feet of truck, and it scares everyone. All you need is that one driver, that idles his truck all night, keeping, in his own neighborhood, and we are all disrespectful. All you need, is that small group of drivers, to piss up a Walmart parking lot, and we are all pigs. This is how it happens folks. Man Acquitted of Killing 7 Motorcyclist I remember it like it was yesterday. In 2019, it was all over the news. How a young man killed a bunch of people riding their motorcycles in New Hampshire. The story talked about how it was all the truckers fault. After spending almost the entire time since then, the trucker was set free, after the verdict was read. While on trial, evidence showed, this trucker had been using heroine and other hard core drugs, the day of the accident. But it showed other things too. Apparently, some of the motorcycle riders were past the legal limit of alcohol in their system. All a good lawyer needs to do, is create doubt in the jurors minds. It seems, this is what happened. Witness accounts showed how the trucker was driving erratic, weaving back and forth on this 2 lane road. But all you have to do is make the jury think, there is a chance it wasn't the accused fault, and "not guilty" can be the result. Tune in and hear the breakdown of this tragedy. Francis Hall (the wife) surrendered to authorities this past week and was charged with insurance fraud. This is a charge that stems back to a life that led to that terrifying day. Francis was indicted on charges of fraud on June 30th and had been missing since that day. She has returned to face the charges and hopes to be exonerated. Now her case will be heard in front of her peers in a legal court. Convicted of murder, Francis did her time. Hall completed a 2 year sentence for the murder of her husband. Lease Purchase & Fuel Surcharge Explained. Should a driver partake in a lease purchase in todays market? The answer in short is "yes" if you are getting a fuel legit surcharge and "no" if you are not. If you are not getting a surcharge, you are getting "ripped-off". In short a fuel surcharge is given to a driver for the high cost of fuel. The way it works is this. For every .06cpm the fuel climbs above $1.20 per mile, a truck driver should receive .01cents for a surcharge. Example: If the cost of fuel is $6.00 per gallon. You would subtract $1.20 from $6.00. The remainder would be $4.80. You would then divide $4.80 by .06. The answer is .80 or .80cpm. If you ran 3000 miles this week with a surcharge of .80cpm, you should receive $2400 miles in a separate check for your weekly surcharge. This surcharge should be separate from the rest of the equation. this means for example, you ran 3000 miles at a rate of $2.25 er mile. The gross would be $6750. If you were getting 80%, your net would be $5400. If you fixed cost is $1500 you would have $3900. Your fuel bill would have been approximately $2500. Subtract the fuel from the $3900 and you have $1400 left. If you are getting paid correctly, the surcharge would then be added on to the $1400. So $2400 Fuel Surcharge plus $1400 equals $3900 total pay. The Big Shut Down (Semi Trucks). In 1973 a truck driver named named J.W. Edwards shut his semi truck down on Interstate 80 in Pennsylvania. His handle on the C.B. Radio was "River Rat". This would be the first time that the American Trucker got a national voice. Frustrated with an oil embargo Edwards had enough. With diesel jacked high in price and sanctions set on fuel supplies, he was sick of barley making it from fuel stop to fuel stop. Running out of fuel, he decided to shut down right there and hop on his C.B. Radio. With in a day, 10 states were seeing protests and gridlock on the interstates and major highways. Along with the embargo, there was a national push to limit long haul truck drivers to 55mph. This would mean more frustrations and less pay for the truckers. For the most part the protests were deemed peaceful. All but one state, Ohio, was relatively calm. Set state of Ohio however, called for the national guard to remove truckers from picketing and they used tear gas to do it. Never before and since then has there ever been a united force of truckers that effected Americas highways the way this time period did. Truckers yesterday and today United We Stand Divided We Fall Trucker back then used the C.B. Radio for most of their communication. In just one day, their protests were nationally known throughout the community of trucking. They stuck together and were heard loud and clear. Today, it's hard to get two truckers to agree. What Happened On Interstate 10. This past week on Wednesday 6/15/2022 we were traveling east on Interstate 10 in Florida. A digital sign warned motorists of an accident 26 miles ahead. It also said the right lane would be closed. When we arrived to the scene which was mile marker 111. We noticed a tractor trailer off the road laying on its side. Just ahead on the left side, another tractor trailer laid on its side also. We tried all week to find out about this accident. Checked the news outlets. We searched the Internet. We combed everything we could and still no answer. Not one word out there about this accident. How odd is that? Bob thought he was all set and was just an ornery man when it came to the operations manager. Unfortunately for Bob, the ops guy was more valued than Bob. Tragedy After Trucker Failed To Move Over. The move over law is designed to protect emergency personnel from getting hurt on the side of a road. Heavy fines and a mark on your driving record could be the results of not moving over. Recently a trooper in New Hampshire was killed when a truck driver failed to move over. Jay Paul Medicos, 43, has been charged with negligent homicide and reckless conduct with a deadly weapon, killing 44-year-old state police Staff Sgt. Jesse Sherrill on Oct. 28, 2021.  State police allege Medeiros failed to obey 2 warnings prior to the crash. He also failed to move over for the trooper striking the cruise he was in. The trooper was transported to Portsmouth Regional Hospital where he was pronounced dead. Medeiros allegedly ingested marijuana 3 days prior to the crash. They also allege he was storing other marijuana in his semi truck. Important Info For Truckers. If you are an Owner Operator or a Lease Purchase Driver, this podcast is for you. Right now most owners are suffering from the high cost of fuel and declining freight rates. Freight rates have been plummeting for the last 5 weeks and it is not showing signs of recovery. With the influx of drivers in the industry the demand for carriers to haul freight has made rates more competitive. The bargaining power has shifted from carrier to shipper. The price of fuel has also effected the trucking industry in a bad way. Between the dropping rates and the high cost of fuel, it has created a perfect storm if you will. The question is, how can we combat this situation? If you are not getting a surcharge then you are getting ripped off. Here is how a surcharge works. The DOE (Department of Energy has set the mark at $1.20 per gallon a long time ago. What this means is, for every .06 cent above $1.20 a driver is suppose to get .01cpm surcharge. For example, the average gallon of fuel is about $6.00. If you subtract $1.20 from 6.00 you have $4.80 left. You then .06 into 4.80 and you get .80cpm surcharge. Which means if a driver ran 3000 miles, he should get an additional $2400 for a surcharge check. This should be separate from his pay. The bottom line, if you are not getting a surcharge that you are able to see, you are being ripped off. Without a surcharge, it is very hard to make big profits. The report says that truck drivers attribute to over 40% of "at fault" accidents on the highways. Previous articles from various groups have truck drivers at a much lower rate. When Truck Drivers Go Postal. A truck driver walked into a trucking company and killed his boss with a gun. He then went to another trucking company and shot a female. Unbelievable he went to a third trucking company and inquired about a third person. That person was not there at the time. Jeremy Spicer then walked to another business and hid in the bathroom. Eventually he turned the gun on himself. Reports are saying he had an issue with a second load and was about to be fired. Ultimately he turned the gun on himself. This was a tragedy for all involved. This includes the goals. Sam Hicks took his eyes off the road for 8 seconds. He was traveling at 63mph. His truck struck and killed Robert Bursik, 54. When Truckers Die Away From Home. Truck drivers are killed at a rate of 800 to 1000 times a year. That's an average of 2.7 truckers per day. In many cases, family members are abandoned by the trucking company that offers no help in retrieving the body. We recently heard of a trucker that was killed while on the road. His wife attempted to contact the company for help bringing him home. She did not get so much as a phone call. This happens more often than none. Trucking companies all across America feel they have no responsibility to help recover the driver that was committed to them, hauling their freight. There is an answer to this madness. Truckers Final Mile, is a Non-profit organization set up to help this particular problem. Robert Palm, the founder of TFI has seen his share of these issues over his career. He experienced first hand, a trucking company refusing to help him, when he was involved in a wreck many years ago. In 2012 he started Truckers Final Mile to help families get their loved ones home once they have died on the road. Many families live pay check to pay check. Trucker Bites IT AT Rest Area. Nurgazy Mamyrov a trucker from Longhorn PA, was shot and killed in the early morning hours of October 5th 2021. Mamyrov was involved in a few incidents with citizens before state police were called to the scene. When state police arrived, they found Mamyrov arguing with another driver. Both were speaking in Russian language. At that moment the other driver was taken into custody. Police tried to coax Mamyrov out of his tractor but had no luck in doing so. Trucker Bites IT AT Rest Area Mamyrov started his truck and proceeded to ram forward forcing police to shoot at the vehicle. He was pronounced dead at the scene. Trucking Company Hired A Killer. Yaimy Galan Segura, Owner Castellano 03 Trucking LLC, the trucking company that hired Rogel Aguilera-Mederos, gave a deposition after the accident. Segura's deposition was made public recently and we have a partial copy. In the writings, she admitted she knew nothing about the trucking industry. Rather she had a neighbor that owned a small company and was doing well. With advice from friends and researching the internet, Yaimy started her very own trucking company. In an arbitration, also obtained by TalkCDL, she disputed the fines she had received. With barley over $10, 000 in fines Segura went to arbitration to dispute. Records show that she was fined for numerous violations including one count is for violating 49 CFR 382.301(a) (“No employer shall allow a driver, who the employer intends to hire or use, to perform safety-sensitive functions unless the employer has received a controlled substances test result from the [named entities] indicating a verified negative test result for that driver.”). She was also fined for Ten counts are for violating 49 CFR 395.8(e)(l) (“No driver or motor carrier may make a false report in connection with a duty status.”). Examples of these counts involve driver reports indicating that the driver was in a vehicle’s sleeping berth, although at such times the driver was driving the vehicle. Savanah struck and killed deputy Sgt. Chris Jenkins, who was removing debris from the road. Savanah was charged with DWI, Vehicular homicide, possession of a hand gun while under the influence and many more charges. Elon Musk Trucker Killed Plus Ruthann. The his week a tragic accident in Texas. Apparently two semi trucks collided in Kermit near San Angelo TX. One driver was killed when the sand truck that was involved spilled its content into the cab of the other driver burying him alive. This kind of accident is so rare that is stunned everyone that heard about it. Bridge Collapse in Pittsburgh A bridge collapsed this past week during the morning hours. At about 7a.m. the bridge in Forbes avenue in Frick Park just fell down injuring 10 people and sending 3 to the hospital. There were no fatalities to report at the time. Authorities said the bridge had been inspected this past September. They said it had gone through a vigorous inspection and past with flying colors. A gasoline was ruptured and had to be repaired. The scene was approximately 4 miles from the site where President Biden was to give a speech on his infrastructure plan.
