Sari Swears Podcast: Trial Debrief: Matthew Wilson on Turning Down $400K and Winning $1.8 Million19 Jun 202600:38:14

Most lawyers would have taken the $400,000…

The plaintiff had healed. No surgery. Relatively modest medical bills. Plenty of risk heading into trial.

But attorney Matthew Wilson saw something bigger.

In this episode of Sari Swears, Matthew breaks down how he turned down the highest offer in the case, took it to verdict, and watched a jury return $1.8 million.

More importantly, he shares what changed his approach in the courtroom.

For years, voir dire was the part of trial that terrified him most. Then he started doing something different—having real conversations with jurors instead of relying on the same old script.

In this episode, you'll hear:

  • How a "small" injury case became a seven-figure verdict
  • The overlooked damages that resonated with jurors
  • What focus groups revealed about suing a city
  • How authenticity changed Matthew's entire approach to voir dire
  • The moment he realized jurors don't need perfection—they need a real person

And perhaps the most powerful part of the story isn't the verdict itself. 😉

Love,
Sari

Sari Swears Podcast: It's My Canciversary! This One's a BIG Fucking Deal Y'all11 Jun 202600:24:52

Today marks five years since the day I learned there was no more cancer in my body.

It's a milestone that means more to me than I can put into words.

In this week's podcast episode, I'm sharing the full story—from the diagnosis that changed everything, to the moments I was certain I couldn't do it, to the people who carried me through when I couldn't carry myself.

It's a story about hope, gratitude, and what it means to keep going when you don't know how the story ends.

If you've ever walked through a hard season—or loved someone who has—I hope you'll listen. 💖

Love,
Sari

Sari Swears Podcast: Do You Want to Quit Practicing Law? Listen to This First.10 Apr 202600:38:51

Have YOU ever thought:

"I don't think I want to do this anymore."

Not forever.

Not dramatically.

Just… quietly, in the back of your mind.

In this week's episode, I sat down with Coach K to talk about why so many trial attorneys hit this exact point.

And no, you're not alone. 😉

What we've seen time and time again is this:

It's not that you actually want to quit… It's that you can't keep doing it the way you've been doing it.

Doing everything yourself.

Carrying too much.

Feeling stuck in a system that's draining you.

And here's the shift…

That moment where you start questioning everything?

That's not the end.

It's the turning point.

Inside the episode, Coach K and I break down:

  • Why this feeling is so common for trial attorneys (even my Masterminds)
  • The problem in tackling everything alone
  • And how to shift out of this mindset

If you've been on the edge of quitting, this one is for you.

Love,
Sari

"I don't think I want to be a trial attorney anymore… or it's, 'I don't know, I might be crazy for saying this, but I've been wondering if I even want to do this anymore.' We hear that all the time. And out of all the hundreds of trial attorneys we've worked with… almost none of them actually quit."

Ep. 248 - Do We Learn More From Success or Failure? You Might Be Surprised By the Answer19 Apr 202400:20:18

I always hear this from attorneys in and out of H2H –

"I learned more from my failures than my successes."

Well, throw that bullshit out the window because this week's episode is all about debunking the myth that failure is the ultimate teacher.

Tune in to find out how to break the cycle of fixating on mistakes (because let's face it, that only leads to one thing: giving up 😤) and instead, champion a mindset fueled by success.

Sari

  • "We learn more from success than failure. Success is more motivating than failure. Success will have you work harder than failure. This is backwards from everything y'all believe. You believe it has to be hard. You believe you have to be hard on yourself. You believe that you can't decide you're amazing before you actually achieve something great. The research backs me up here. It's success that we want to emulate; it is success that we want to focus on."

Ep. 247 - Which Method Really "Works"? Here's How to Tell12 Apr 202400:23:22

Have you ever researched jury selection methods?

Well I did. And it is slim fucking pickings. Turns out, predicting verdicts based on juror characteristics is about as reliable as a coin toss.

What method really "WORKS"? Long story short.. YOU

This episode is for you if you want to learn the 7 crucial questions to ask yourself when choosing a method.

If your method hits all these marks, you're golden. But if it's just smoke and mirrors, it's time to toss it.

Bottom line: No matter the method, the real magic is YOU.

So go on, be brilliant, and own that courtroom.

Tune in on the episode to find out what I mean by that.

Xo,

Sari

Quote:

"Here's what I know for sure works, you. You work. No method will ever replace the brilliance that is you. That's what I know for sure works. I don't create magic in my studio by myself. The magic happens when I'm working with one of you or one of my crew members. They bring the brilliance. I just help them step into it. That's what I do."

Ep.246 - The Problem with the Ideal Juror Profile05 Apr 202400:20:41

It's time to forget everything you know on the "ideal juror profile" and ditch the outdated playbook. Capeesh?!

Ok, now that's out the window…

This episode is for you if you want to learn powerful ways of creating the ultimate "ideal juror profile".

(Spoiler alert: it's not your typical demographic; a woman between the ages of 40-60, college graduate, blah, blah, blah. #Boring.)

Tune in on the episode to find out what I mean by that.

Xo,
Sari

Quote:

"So, the problem with the ideal juror profile is you're using it for the wrong reasons. You're trying to find the fix to the defense point when it really is meant to show you that your ideal juror exists. And that once you build those beliefs, that there are principles in there that you can mind for, and then start building your funnels."

Ep. 244 - Do You Struggle with Feeling You're Not Good Enough? Here's How to Stop22 Mar 202400:11:00

If you struggle with constantly feeling like you're not "good enough", this episode is for YOU, my friend.

Today, we are talking about how ABSURD it really is for us humans to relentlessly keep striving to be "enough".

So, if you're ready to embrace your imperfections, laugh in the face of doubt, and rewrite the rules on what it means to be "enough", tune in now.

Xo,
Sari

Quote:

  • "It's like the concept of over-preparing. It's this thing where we're like, "I want to be 100% prepared." That's not a measurable thing. It's not something that we can say, "Okay, now you're enough." How do we decide what that is? Fuck enough. Here's what you're really saying, "I don't know what I'm doing." That's what you mean when you say, "I'm not enough." And here, my darling, is the answer to that, no one does. No one knows what the fuck they're doing. I don't know what the fuck I'm doing. Literally, no one knows what the fuck they're doing."

Ep. 243 - Curiosity: What Killed the Cat Will Save You15 Mar 202400:18:01

Curiosity may have killed the cat, but it's about to resurrect your trial game.

Curiosity isn't just about asking questions; it's about forging connections that transcend courtroom formalities.

Curiosity isn't about having an end goal in mind. It's about embracing the unknown.

I know you're DYING to revolutionize your approach to voir dire, so go ahead and tune in.

This is getting to know each other. This is connecting you with the themes, with me, with each other. The very work that y'all do is human work. It's about connection. And I honestly believe we cannot have connection when we don't have curiosity."

Ep. 242 - Why You Have to Make the Jury Uncomfortable08 Mar 202400:16:15

Are you ready to shake things up?

Good, because that's exactly what we're about to do.

In our latest episode, we're diving deep into the nitty-gritty as to why you HAVE to make the jury uncomfortable in voir dire or in your opening statement (and YES, it will make YOU feel uncomfortable, too, but that's the point.)

I'll teach you how to captivate, motivate, and inspire action from the jury through the power of storytelling and more.

So if you're tired of playing small and ready to make a real impact, this episode is for you.

Ep. 241 - My Advice for Young Lawyers01 Mar 202400:20:24

This episode is dedicated to my young lawyers.

Trial lawyering is literally one of the biggest mindfucks that could ever happen to a human being.

That means that you NEED to have your own back, and give yourself grace and compassion.

Tune in to find out my top three advice for YOU as a young lawyer that if you use to shape your career, one, unlike Joe, you'll get to skip the never-ending search for the "formula", and two, you will never have to worry about winning again.

Xo,
Sari

  • "You have to have your own back and talk nicely to yourself, because you're going to have a lot of bosses that are not going to talk nicely to you. You're going to have a lot of opposing counsel that's not going to talk nicely to you. You're going to have a lot of judges that are going to dress you down in front of the fucking jury. You've got to be the one person in your world that has your own back, that tells yourself, 'I could have done that differently, I did miss that, but I'm still a worthwhile person and I'm going to get this and I'm going to learn it.' Because what you're going through right now is already fucking hard. Don't make it harder by being your worst enemy."

That means bucking the system. That means taking big risks. That means going all in with storytelling, feeling your feelings, getting emotional, being totally and completely authentically you."

Sari Swears Podcast: How to Handle Non-Economic Damages at Trial (Encore Episode)03 Apr 202600:33:32

I'm bringing this episode back because this question keeps coming up:

"How do I explain my number for non-economic damages?"

And here's the truth…

You don't.

At least not the way most attorneys try to.

There is no real formula for non-economic damages.

And when you try to force one… jurors can feel that it's not real.

What they're actually looking for is much simpler: Do YOU believe the number you're asking for?

In this episode, I walk through:

  • The difference between price vs. value

  • Why jurors don't need a calculation

  • And how to present your number in a way they'll trust

If you want to actually practice this, my Damages Masterclass is happening THIS June, and this is exactly what we work on.

It's small group, hands-on, and designed to change how you show up in court.

Give the episode a listen, and if this is something you've struggled with, come work through it with me in June.

Tune in NOW! 🎧

Love,
Sari

Ep. 238 - It's Ok to Want More (Truly)09 Feb 202400:15:59

What's YOUR dream?

For ME, my dream is to change the way law is practiced. And I'm doing it. But I'm not doing it ALONE. The H2H Crew, my rock through surviving cancer (You know who you are, and I love you! 🥹), has proven that I don't have to do things alone.

And together, we are changing the game for lawyers across America – from how voir dire is practiced to how lawyers are living their day-to-day lives. It's fucking incredible, really.

If anyone deserves to chase their dreams, it's YOU. The saboteur can throw all the arguments it wants, but YOU get to have whatever the hell you want.

So push through, chase your dreams, and discover your true meaning of fulfillment.

And I'm here to guide you, every step of the way. I swear.

Xo,

Sari

You're going to save the world. I firmly believe it. So if you are not allowed to chase your dream, then who the fuck is? You are literally keeping the rest of us safe. You're the only thing between us and corporate greed. You are the last resistance. I believe it wholeheartedly. This isn't something I'm just trying to make you feel good about yourself. That is what you do. And I, for one, want you to be happy and fulfilled and doing all of the amazing stuff because you worked for it, and you sacrifice so much for the rest of us."

Ep. 237 - Nonverbal Influence: It's Not What You Think02 Feb 202400:22:40

Welcome to today's podcast episode — a VIP backstage pass to the covert world of nonverbal influence in the courtroom.

I know you're searching for answers, eager to master the art of nonverbal communication, and your Finnish mama is here to deliver. But not in the way you expect. 😜

I'm giving you the lowdown on eye contact, voice, and body language, under ONE condition —  promise me you'll use these steps to be strategic, purposeful, and to ethically enhance the work you're already doing, not to manipulate or replace it.

Alright, I'll leave ya to it.

We never make eye contact with them. I bet you never thought about using eye contact in a systematic way of not looking at somebody. You are so trained to make eye contact, it never even enters your brain that most of the time, you can use it and not look at people on purpose because you're trying to do some cool shit. In service to you, your case, and your client. Not to manipulate, or to be unethical."

Maybe it's an 8-figure verdict, or your dream house, or dream car, or hell, your dream life! You name it.

It's always about feelings, which is why so many of us go through life constantly changing our circumstances, in a search for happiness, and we're not going to find it there. We're never going to find our happiness in things or people or jobs, ever."

HAPPY FUCKING NEW YEAR! 🎉 Welcome to SEASON 6!

In this episode, we're breaking the fuck AWAY from the idea of work-life balance.

Xo,

"Here is how I suggest you go about having the work-life balance that I know you all crave. So, for example, most people – when we are talking about how to manage your time, have work-life balance, or manage a to-do list – what we do is we take all the things that we have to do and then we try to fit it into the time that we have. Then we bang our heads against the wall until eternity, because it never fucking fits. We always have way more things to do than we have time to do them. We have to get really good at prioritizing and focusing."

Encore Episode - How to Piss the Jury Off in Opening08 Dec 202300:17:22

In this encore episode, I'll teach you how to piss the jury off. But not in the way you might expect. 😉

By the way, if your opening is over 30 minutes long, then you're abso-fucking-lutely pissing them off. In a really bad (and wrong) way.

That's not what I'm talking about here. I'm talking about pissing them off to a point where you motivate them to act.

-Sari

Shout out:

"That's the point of the teaching section. So when you're putting together your teaching section, what I want you to ask yourself is, 'What should have happened here?', 'What was the right thing to do?', ' What was the thing they chose not to do?', 'What was the thing they bypassed?' That's where we start."

Sari Swears Podcast: If Time Is Tight, Cover THIS in Voir Dire (Encore Episode)27 Mar 202600:20:01

This is my most listened-to podcast episode… ever. 🤯

So I'm bringing it back.

If you've ever thought:

"I don't have enough time in voir dire"

"This judge limits us"

"I can't get through everything I want"

This episode is for you.

Because the truth is, you don't need more time.

You need to focus on the right things.

In this episode, I walk you through the three principles you MUST get from jurors:

👉🏽 People should take responsibility when they hurt someone
👉🏽 Money holds people responsible
👉🏽 Money can help

That's it.

If jurors say these out loud, they begin to align.

And when they align, your job gets a whole lot easier.

This is the foundation.

Whether you have 20 minutes or two hours, THIS is what matters.

Tune in NOW! 🎧

Love,
Sari

Encore Episode - Four Questions to Help Jurors Give You the Principles in Your Case01 Dec 202300:25:16

Let's get one thing straight—jurors should be handing YOU the principles, not the other way around.

You've got to ask the right questions, though.

In this episode, I give you the 4 questions to ask jurors, and I'll show you how social science supports this new approach. Spoiler: it's not what you've been taught in law school.

I'm telling you, I know what I'm talking about.

It's about knowing your principles and making jurors serve them to you on a silver fucking platter.

Encore Episode - Why You Need to Use the Coffee Rule in Voir Dire24 Nov 202300:08:39

I'll be blunt—spewing words like "subsequent," "prior," "motor vehicles," or phrases like "Who here has experience with…," "By a show of hands..." makes my head fucking hurt. You sound like a FREAK, and it's got to stop! WHO are you talking to? If you are wanting to connect with jurors, you've got to cut the bullshit lawyer-speak and remember how to talk like a normal person—like you're having coffee with a friend.

Here at H2H, I teach the coffee rule: be a human, not an attorney robot. You want the jury nodding, not scratching their heads.

Ep. 231 - Hard Work Won't Get You Where You Want to Go13 Oct 202300:19:06

"Putting a lot of energy into an activity."

☝️That's the actual meaning of hard work.

And I LOVE it.

According to that definition, I work very hard because I put a fuck ton of energy into what I do.

But y'all tend to be more familiar with a few other definitions of hard work, like… "difficult to bear" and "causing suffering."

Hard work is NOT the only determinant of success, especially if you're a woman or a person of color in the United States.

Tune in to this very sweary episode of the FHTH podcast to learn more about my thoughts on the subject.

Enjoy!

Quote

"When we're touting that hard work is all it takes to get ahead in life, in your career, or in trial, it's fucking bullshit. For at least half of the United States being women and then add in all the people of color on top of that, it just doesn't fucking work that way. And because you all keep believing that it does, it's not doing you or your sisters or people of color any favors."

Ep. 228 - Why Jurors Aren't As Outraged As You Think They Should Be22 Sep 202300:18:50

If your jurors aren't as outraged about the details of your case as you think they should be, I have a question for you:

Did you give them evidence, information, and facts? Or did you give them passion?

Because if you spoke about the horrific details of your case without any inkling of emotion in your voice… why would you expect the jury to feel anything but "meh"?

If you're going to effectively motivate your jurors to give you your verdict, you need them to be emotionally invested in your case.

How do you do that?

Tune in to today's episode of the FHTH podcast to learn how to get your jurors "appropriately rageful."

Sari Swears Podcast: Are You Using the Jury Inappropriately?20 Mar 202600:22:45

What if the issue isn't your case… but HOW you're thinking about the jury?

Most lawyers won't say this out loud, but it's happening.

You're asking the jury to do MORE than their job.

Not just decide the case, but decide if you're good enough.

If they rule in your favor → you feel validated.

If they don't → you question everything.

That's the trap.

Because the jury's job is simple: hold bad actors accountable.

That's it.

They are NOT there to:

🚫 Like you
🚫 Validate you
🚫 Prove you're a good lawyer

And the moment you start needing that from them…

YOU stop serving them and start trying to get something from them.

They can feel that.

🙅🏽‍♀️Stop asking, "What do they think of me?"

✅Start asking, "How can I help them do their job?"

That's where everything changes.

Tune in NOW! 🎧

Love,
Sari

We tend to think, I've got to have the big verdicts and do the cool trial lawyer shit, and then I will be a great trial lawyer. But the opposite is true. You have to decide right now that you are a terrific trial lawyer because once you firmly believe that and start wiring your brain to believe it, you will start doing the things great trial lawyers do. Then you will have the results that they're getting.

Ep. 222 - How To Decide Your "Number" In Rural Jurisdictions04 Aug 202300:20:35

If your case involves a brain injury or the death of a human, you should be asking for seven figures, right off the bat… if not eight or nine.

I don't care if you're in a rural jurisdiction or not.

A brain is a brain, and a life is a life.

As long as your case has good facts and you're arguing it well and doing ALL the things I want you to be doing, you can get your seven- or eight- or nine-figure verdict in ANY jurisdiction.

Now. Maybe you're thinking:

But Sari, nobody's ever asked for seven figures in this jurisdiction!

or

But nobody's ever won eight figures in this jurisdiction.

My question to you is:

Has anyone ever fucking ASKED for those numbers?

Because, y'all, this is NOT a jurisdiction issue. It's a mindset issue.

Tune in to today's episode of the FHTH Podcast to find out what I mean.

Enjoy!

Sari

Ep. 221 - Preponderance & Preemptory Challenges: Why You Don't Need Either One28 Jul 202300:17:06

Did you know that Arizona no longer has preemptory challenges?

That means the only way for an attorney in Arizona to get someone off the jury is to go in for a cause challenge.

I know this because I was working with some Arizonan clients a couple months ago and the topic came up…

What we were going to DO about this? Should we really bring back the preponderance question?

Now, some of y'all might be wondering what I mean by "bring back" the preponderance question.

Here's the thing: I don't train attorneys to use the preponderance question in voir dire.

I have a few reasons for this, and I'll be discussing them in today's episode of the FHTH podcast.

Tune in to learn three myths and three truths about preponderance.

Enjoy!

Ep. #220 - Stop Doing THIS at Trial (Unless You Want to Tank Your Case)21 Jul 202300:19:42

If you're primarily talking about money in voir dire, you're essentially telling the jury that's what your case is about.

And here's the problem with that…

Your case is N-E-V-E-R about money.

Someone has got to start changing this conversation because what you're doing has zero to do with money, and everything to do with holding bad actors accountable.

Today's FHTH podcast is the recording of last month's live episode.

If you missed it, listen in to find out what I want you to stop doing at trial (unless you want to tank your case).

And if you were there for the live recording, here's your chance to hear it again!

Enjoy!

And yet your response to that is to come in and make all of your voir dire about who can give money and who likes lawsuits. You've just fucking proved their point."

Ep. 219 - How to Incorporate More Play Into Your Practice14 Jul 202300:27:23

I love y'all, but you sure take yourself too damn seriously sometimes. (*cough* most of the time)

Yes, I know your work is heavy, and you deal with tough fucking shit on the daily. I am not making light of that.

But, I am strongly suggesting that you practice getting out of your head a LOT more often.

The best way to do that is to play more! Yes. Play.

Play is not only a fun thing to do, but it is integral for you to do as a human being, particularly a human being who is also a plaintiff attorney.

Tune in to the new episode of the FHTH podcast to discover my "3 Ps of Play" and why play is so important!

Enjoy!

Sari Swears Podcast: Should You Be Spending MORE Time on Defense Points With Special Guest Chrissy Hagen13 Mar 202600:36:06

One of our H2H™ crew members, Chrissy Hagen, recently tried a medical malpractice case that resulted in a defense verdict.

After trial, she reached out with a great question:

Should we be spending MORE time addressing defense points during trial?

In this episode, we talk through:

👉🏽 The med mal case involving a delayed prostate cancer diagnosis
👉🏽 What Chrissy heard from jurors after the verdict
👉🏽 Why some jurors admitted they "flipped" during deliberations
👉🏽 The concept of defensive attribution and how it shows up in trials
👉🏽 And the bigger lesson: WHY framing matters more than time spent on defense points

As we dug into the case, something important emerged.

The real issue in this case wasn't just the delayed diagnosis.

It was agency.

A doctor making a decision for a patient instead of giving that patient the information needed to make the decision themselves.

And when you find the real piss-off point for jurors, everything about how you frame the case can change.

If you've ever walked out of a courtroom wondering what happened in that verdict room, this episode is for you.

Ep. 218 - How To Design An Alliance With Anyone07 Jul 202300:16:50

If you've experienced the power of Designed Alliance in voir dire, wait 'til you try it in your everyday life.

That's right, my friend. Once you learn the incredible skill of "design," don't save it for jury selection!

Use that shit everywhere and anywhere you want buy-in and/or a win-win outcome.

I'm talking with friends, clients, colleagues, children, spouses, siblings, etc.

Even while planning a trip to Disneyland… which I'll discuss more in today's episode of the FHTH podcast.

Tune in for all the details!

(And if you don't have a fucking clue what I'm talking about, I'll explain it in the episode, don't worry.)

Enjoy!

Ep. 217 - The Secret Hack to Motivation30 Jun 202300:15:35

If you're relying on willpower to make changes in your life, that's probably why you're not seeing results.

That's because human beings don't have an unlimited amount of willpower, so we shouldn't depend on it to motivate us when we're trying to create lasting change.

Guess what? Rewards don't work, either.

So. What should you do when you want to motivate yourself?
