If your jurors aren't as outraged about the details of your case as you think they should be, I have a question for you:

What if the issue isn't your case… but HOW you're thinking about the jury?

Most lawyers won't say this out loud, but it's happening.

You're asking the jury to do MORE than their job.

Not just decide the case, but decide if you're good enough.

If they rule in your favor → you feel validated.

If they don't → you question everything.

That's the trap.

Because the jury's job is simple: hold bad actors accountable.

That's it.

They are NOT there to:

🚫 Like you
🚫 Validate you
🚫 Prove you're a good lawyer

And the moment you start needing that from them…

YOU stop serving them and start trying to get something from them.

They can feel that.

🙅🏽‍♀️Stop asking, "What do they think of me?"

✅Start asking, "How can I help them do their job?"

That's where everything changes.

If your case involves a brain injury or the death of a human, you should be asking for seven figures, right off the bat… if not eight or nine. 

I don't care if you're in a rural jurisdiction or not. 

A brain is a brain, and a life is a life. 

As long as your case has good facts and you're arguing it well and doing ALL the things I want you to be doing, you can get your seven- or eight- or nine-figure verdict in ANY jurisdiction. 

Now. Maybe you're thinking:

But Sari, nobody's ever asked for seven figures in this jurisdiction!

Did you know that Arizona no longer has preemptory challenges?

That means the only way for an attorney in Arizona to get someone off the jury is to go in for a cause challenge. 

I know this because I was working with some Arizonan clients a couple months ago and the topic came up… 

What we were going to DO about this? Should we really bring back the preponderance question? 

Now, some of y'all might be wondering what I mean by "bring back" the preponderance question. 

Here's the thing: I don't train attorneys to use the preponderance question in voir dire.

If you're primarily talking about money in voir dire, you're essentially telling the jury that's what your case is about. 

And here's the problem with that…

Your case is N-E-V-E-R about money.  

Someone has got to start changing this conversation because what you're doing has zero to do with money, and everything to do with holding bad actors accountable.

I love y'all, but you sure take yourself too damn seriously sometimes. (*cough* most of the time)

Yes, I know your work is heavy, and you deal with tough fucking shit on the daily. I am not making light of that.         

But, I am strongly suggesting that you practice getting out of your head a LOT more often. 

The best way to do that is to play more! Yes. Play. 

Play is not only a fun thing to do, but it is integral for you to do as a human being, particularly a human being who is also a plaintiff attorney.
