La puntata trae spunto da un evento organizzato da LES Italia dedicato a Sport, IP, Business, Licensing e Ambush Marketing, e analizza alcune delle questioni più rilevanti emerse in occasione delle Olimpiadi Invernali Milano-Cortina 2026 e dei recenti Campionati Mondiali di Calcio 2026. Per affrontare questi temi, abbiamo il piacere di ospitare: Avv. Ambush Marketing: il quadro normativo italiano e i casi Milano-Cortina 2026: approfondiamo la disciplina introdotta dall’art. 10 del D.L. n. 16/2020, le recenti decisioni dell’Autorità Garante della Concorrenza e del Mercato e l’importante pronuncia del Consiglio di Stato sul caso Zalando. Le nuove sfide del marketing digitale: hashtag, influencer, social media e contenuti generati dagli utenti stanno trasformando le modalità con cui si manifesta l’ambush marketing. Discutiamo se gli strumenti normativi attuali siano sufficienti e quali strategie potranno essere adottate in vista dei prossimi grandi eventi globali. Le clausole essenziali nei contratti di licensing sportivo: una panoramica pratica sulle tutele contrattuali più rilevanti per licenzianti e licenziatari, con particolare attenzione a controllo qualità, esclusiva territoriale, royalties, enforcement e gestione del contenzioso. Three years ago, the Unified Patent Court opened its doors across Europe. The question then was: will it work? Today, the answer is taking shape — and a new set of questions is emerging. Per affrontare questi temi, abbiamo il piacere di ospitare: - Avv. Beatrice Cuseri – Avvocato presso lo studio Nunziante Magrone, membro LES Young; - Avv. Marco Venturello – Avvocato presso lo studio Venturello e Bottarini, membro LES Italia. Insieme, esploreremo tre temi di grande impatto pratico: 1. Tribunale Unificato dei Brevetti e opt-out: a partire da una recente e discussa ordinanza del Tribunale di Venezia, analizziamo la questione della competenza concorrente tra UPC e giudici nazionali durante il periodo transitorio e le criticità interpretative dell'articolo 83 dell'UPC Agreement. 2. Stabilizzazione dei provvedimenti cautelari: la Corte di Giustizia dell'Unione Europea, con la sentenza nella causa C-132/25, ha dichiarato incompatibile con la direttiva Enforcement la stabilizzazione dei provvedimenti cautelari prevista dal Codice della proprietà industriale italiano, aprendo un dibattito sulle conseguenze pratiche per imprenditori e professionisti e su una possibile disparità di trattamento rispetto ad altre materie. 3. Il caso Fiorentina – Diritto all'immagine, marchi e ambush marketing nello sport: analizziamo le sentenze del Tribunale e della Corte d'appello di Firenze su un caso che intreccia il diritto all'immagine delle persone giuridiche e dei beni, la contraffazione di marchi notori e lo sfruttamento parassitario dell'identità commerciale di una società sportiva. The Syngenta vs Sumi Agro case: business aspects of intangible assests - why IP is so important?

Sumi Agro, where the Munich Local Division (LD) of the Unified Patent Court (UPC) ruled that distributing a patent-infringing product outside the UPC Contracting States, while advertising the product under the same name within a UPC Contracting State, creates a risk that patent-infringing products could be manufactured, marketed, and distributed within the UPC Contracting States in the future. With our guests, we will talk about how this decision reflects broader trends in managing IP risks and opportunities - especially in innovation-driven sectors - as well as discussing some issues that will be will be explored at YMC Pan-Conference to be held in Vienna on November 15th .
