Can you suspend an employee while there's an ongoing investigation (PREVENTIVE SUSPENSION)?14 juil. 202200:27:56

I was put on a preventive suspension for 5 days due to neglect of duty, I am working as a supervisor in a BPO company. I received an NTE letter that would last for 5 days, I provided my explanation in less than 5 days, but they won't let me report for work while the case is still ongoing and now it is more than a month and I haven't received any NOTICE OF DECISION. Am I not eligible for payroll for those days while the case is ongoing? and why did the company take more than a month to decide?" - Lino G.  "If the employer sent a notice of preventive suspension can the employee go to duty or report at work or not anymore?" Hyacynth T.  Interesting topics. How should you pay the estate taxes of your deceased parents?07 juil. 202200:29:02

What if you’re going to sell a property you inherited but it’s still in the name of your parents? How should you settle the estates of a deceased married couple? Where should you pay the estate tax for each of them?  A lot of the properties we help buy or sell, are usually inherited properties that are still in the name of the parents, grandparents, or even siblings of grandparents. And the big problem here which complicates the sale is that all their estates have not yet been settled. This is the question of one of our viewers, Anthony and he writes:    “Property is located in QC with both names under mother and father.  Mother died in the province as indicated in the death cert. Father died in QC as indicated in death cert. My father died a few years after my mother. Will the estate tax be settled 50% in the province and 50% in QC?”  If you’re having issues transferring your land or have issues transferring the properties of a loved one who passed away, we have something that can help. We recorded an FAQ session where we answered the most common questions related to estate settlement. You can access the recording by going to https://legalaccess.ph/ and choosing the estate settlement topic there.

Can they require me to stay beyond the turnover period?13 mai 202200:26:11

Can your employer force you to stay in your job beyond the turnover period?

Do you have to stay in your job until a replacement is found before you leave?

Resigning employees face this dilemma sometimes when their employer tells them not to leave until there is a replacement for their position.

But let me ask, is that your responsibility?

Let's find out the answer in our discussion!

Let us also know your main takeaways in the comments! 🙂

This episode is brought to you by our free Legal Guide to writing Resignation Letters. It's a free online workshop that gives you a template for writing legally compliant resignation letters and teaches you the reasons for each part. It also gives you a template that you can use.

We'll help you resign properly, enroll for free at info.legalguide.ph/resignationletter to get your free template and orientation today.

Here are a few options on how we can help further:

1. If you want to schedule a private legal consultation with us or see if a legal team can help you, we're happy to consider that. You can go to https://www.legalaccess.ph and then choose the appropriate topic on the site to apply for a legal consultation.

In the alternative, if you prefer free legal representation (pro-bono), here is a list of recommended legal teams that can provide you with help for free: https://www.legalguide.ph/where-to-ask-for-free-legal-assistance

2. If you want to submit a question that we may answer on our show, please submit show questions at https://legalguideph.frill.co/, and if your question gets enough votes, we'll definitely consider making an episode about it.

3. If you just want more information on different legal topics, my advice is to check out our articles at https://www.legalguide.ph/ or better yet, enroll in our workshops at https://legalguideph.gurucan.com/

We hope these resources help you! 🙂

How Do Barangay Officials Help You07 avr. 202200:24:59

What are the roles of the people in the barangay?

And, who would you know who's fit for the position you'll be voting for in the barangay.

When you leave the house, the first officials you'll see are from the barangay.

Tanods are included because they're the frontliners when it comes to government units. But not a lot of people understand.

What are the jobs of different people in the barangay? And, if ever you don't understand what their jobs are, how will you vote correctly?

Because if you don't have a base knowledge of what their jobs are for, this will be your grounds,

"Ah! I know this guy!" Or "That's my neighbor."

But that might not be the best grounds for voting for a candidate.

So in this episode, we will be talking about the smallest government unit there is, and that is the Barangay and its officials.

This episode is a joint project with a Counselor Institute, a nonprofit organization that provides research, policy formulation, advisory, and public communication to create government policies guided by science and research.

Go to www.counsellorinstitute.org for more information.

We will be diving into different people we put into enforcement and rulemaking capacity.

This time, we'll raise it from barangay to the city and provincial levels. For you to understand what we're pointing out. So we look forward to seeing you there.

So wasn't that simple?

Now go make better choices.

Are you confused about this election?  Do you know your votes for, this May?  The wall is too loud. All those comments, there are a lot of colors.  They only talk about the election.  But sometimes, with all of the comments for each candidate, you are the one who'll be stressed out.  You might not know what will you believe in.  And worse, you yourself, do not know where to be at.  You know that your vote is important but you don't know anything, you don't have the tools to know who's fit to vote for.  Yes, that's true.  Sometimes we go with, who is the loudest, who is the most famous and who I always hear about.  But you might feel that might not be enough true to be able to make an educated decision.  So guys, in this series, we will be starting a new series for Legal Guide and the intention is to give you tools to give them what?  Tools, for you to decide properly this election season  It is better for you to understand the power that you hold  By voting and your role in all of this.  Very important because this is our opportunity to build our nation.  This is a big responsibility for our citizens to vote for the upcoming leaders.  The least that we can do as a legal guide is to arm you guys with the knowledge and tools for you to understand who you are voting for.  This episode is a joint project with Councilor Institute, a nonprofit organization that provides research, policy formulation, advisory, and public communication to create government policies guided by science and research.  Go to www.counsellorinstitute.org for more information.  Now go make better choices.

Are You A Dummy Incorporator?10 mars 202200:27:03

Did somebody give you 1 share or 1% share in a corporation just because they needed to complete the minimum number of shareholders?

We see this a lot in family corporations and businesses. Stockholders whose names are placed in the corporation as owners, when in fact they don’t have any investment in the corporation…or they’re not even involved in the corporation at all.

Many times we find that the owners of a corporation include the names of the owner’s children.  Sometimes you will even see secretaries, drivers, or even household helpers named as part owners of the company.

So our question for today comes from Marie G, and she writes:

“Attorney, my friend started a corporation many years back and he asked me if I can be a dummy stockholder for him along with his girlfriend, his mom, and tita (auntie). I agreed. I think he gave me 1%.

Since then I do not have any update on what happened to the company. Sometimes my friend makes me sign things. But when I ask him about it, he tells me that these are routine documents. I’m worried I might get sued someday. What are my rights as a dummy? ”

If you were wondering about the same thing as Marie, stick around.

This episode is brought to you by the "Putting up a Corporation" workshop, an online course that orients you on the basics of starting a company in the Philippines. It talks about what is a corporation exactly, what are the things you should decide on first, before making the leap, and what is the procedure to expect when processing the papers.
